[value] => Am 7. Juli 2016 hat der Europäische Gerichtshof in Bezug auf eine Vorabentscheidungsfrage hinsichtlich der Festlegung der Preise innerhalb der Werbung erlassen. Insbesondere ist zu klären, wie die Europäische Richtlinie 98/6/EG in Bezug auf den Verbraucherschutz im Bereich Preisangabe der Erzeugnisse, die den Verbrauchern angeboten werden, auszulegen ist. Konkret ging es um die Frage, ob Kosten der Überführung eines Kraftfahrzeugs vom Hersteller zum Händler in dem in einer Werbung angegebenen Verkaufspreis enthalten sein müssten.
Der EuGH erinnert daran, dass die Richtlinie 98/6/EG besagt, dass die Verpflichtung, den Verkaufspreis anzugeben, zur Verbesserung der Verbraucherinformation beiträgt, da sie den Verbrauchern optimale Möglichkeiten bietet, die Preise von Erzeugnissen miteinander zu vergleichen. Art. 3.1 der Richtlinie bestimmt, dass der Verkaufspreis bei Erzeugnissen, die Verbrauchern von Händlern angeboten werden, anzugeben ist, wobei als Verkaufspreis der Endpreis für eine Produkteinheit oder eine bestimmte Erzeugnismenge, der die Mehrwertsteuer und alle sonstigen Steuern einschließt, bezeichnet wird.
Der EuGH bestimmt, dass als Endpreis muss der Verkaufspreis notwendigerweise die unvermeidbaren und vorhersehbaren Bestandteile des Preises enthalten, die obligatorisch vom Verbraucher zu tragen sind und die Gegenleistung in Geld für den Erwerb des betreffenden Erzeugnisses bilden. Der EugH stellt fest, dass die vom Verbraucher zu tragenden Kosten für die Überführung des Fahrzeuges vom Hersteller zum Händler in dem in der Werbung angegebenen Verkaufspreis des Fahrzeuges enthalten sein müssen, d.h. der Gesamtpreis angegeben werden muss, wenn sich die betreffende Werbung als ein Angebot des Händlers für das Fahrzeug auffassen lässt.

[value] => Con fecha 7 de julio de 2016, el Tribunal de Justicia de la Unión Europea dictó una Sentencia, en la que resuelve una cuestión prejudicial relativa a la determinación de los precios en la publicidad; en particular, en relación con la interpretación de la Directiva 98/6/CE, relativa a la protección de los consumidores en materia de indicación de los precios de los productos ofrecidos a los consumidores. La cuestión que se plantea es si los gastos de traslado de un automóvil, del fabricante al concesionario, deben incluirse en la publicidad como precio final de venta.
El TJUE recuerda que la Directiva 98/6 tiene por objeto exigir la indicación del precio de venta de los productos ofrecidos por los comerciantes a los consumidores, a fin de mejorar la información de los consumidores y de facilitar la comparación de los precios. El art. 3.1 de la Directiva exige que se indique el precio de venta en todos los productos ofrecidos por los comerciantes a los consumidores, precio de venta que se define como el precio final de una unidad de producto, o de una cantidad determinada de producto, incluidos el IVA y todos los demás impuestos.
El TJUE señala que como “precio final”, el precio de venta debe incluir necesariamente los elementos obligatorios y previsibles del precio, que corran obligatoriamente por cuenta del consumidor, y que representen la contrapartida pecuniaria de la adquisición del producto de que se trata. Por consiguiente señala el TJUE en relación a la cuestión planteada que los gastos de traslado de un automóvil del fabricante al concesionario (si corren por cuenta del consumidor y si resultan invariables), deben incluirse en el precio de venta del vehículo que se indica en un anuncio, cuando éste refleje una concreta oferta referida a dicho vehículo.
