[value] => Das katalanische Parlament hat am 21. Juli 2015 einem Gesetz zugestimmt, durch welches eine Steuer, die auf leerstehende Wohnungen erhoben wird, geschaffen wurde. Das Gesetz wurde von der Zentralregierung vor dem Verfassungsgericht angefochten. Dieses ließ das Verfahren zu und hob die Gültigkeit des Gesetzes vorläufig auf. Jedoch hat es kürzlich diese Aufhebung zurückgenommen, so dass, unbeschadet der zukünftigen Entscheidung des Verfassungsgerichts, das Gesetz, durch welches in Katalonien Steuern auf leerstehende Wohnungen erhoben werden, derzeit vollständig gültig ist.
Der Steuertatbestand ist das andauernde Leerstehen einer Wohnung für einen Zeitraum von mehr als zwei Jahren ohne hinreichenden Grund. Der Zeitraum dieser zwei Jahre beginnt zu dem Zeitpunkt, indem die Wohnung dem Eigentümer zur eigenen Benutzung oder zur Überlassung an Dritte zur Verfügung steht. In diesen zwei Jahren muss der Steuerschuldner ununterbrochen Eigentümer der Wohnung gewesen sein. Die Berechnung der zwei Jahre wird unterbrochen, wenn die Wohnung für einen Zeitraum von mindestens sechs Monaten durchgehend besetzt ist. Natürliche Personen sind von dieser Steuer nicht betroffen. Die Steuerschuldner sind juristische Personen, die das Eigentum an einer Wohnung innehaben, sowie die Träger eines Nießbrauchs-, Baurechts oder jedes anderen dinglichen Rechts, welches ihnen endgültig die Befugnis einräumt, die Wohnung wirtschaftlich auszubeuten. Somit werden die Steuerschuldner im kommenden März, sofern das Verfassungsgericht bis dahin keine Entscheidung getroffen hat, die entsprechende Steuererklärung bei der katalanischen Steuerbehörde einreichen müssen. Andernfalls laufen sie Gefahr Nachforderungen, Verzugszinsen und/oder Sanktionen unterworfen zu werden.

[value] => El Parlamento catalán, en fecha 21 de julio de 2015, aprobó una Ley mediante la que creaba un Impuesto que gravaba las viviendas vacías. Esta Ley fue recurrida ante el Tribunal Constitucional por el Gobierno Central. El Tribunal Constitucional, al admitir a trámite el recurso, suspendió también la vigencia de la Ley pero, recientemente, ha alzado tal suspensión por lo que, sin perjuicio de lo que la futura Sentencia del Tribunal Constitucional determine al respecto, el Impuesto que grava las viviendas vacías en Cataluña, a fecha de hoy, está plenamente en vigor.
La Ley señala que el hecho imponible del Impuesto es la desocupación permanente de una vivienda durante más de dos años sin causa justificada. Este período de dos años se inicia a partir de la fecha en que la vivienda esté a disposición del propietario para ser ocupada o para ceder su uso a un tercero. Es necesario que durante estos dos años, el sujeto pasivo haya sido titular de forma continuada. Es causa de interrupción del cómputo de los dos años, la ocupación de la vivienda durante un periodo de mínimo 6 meses continuados. Las personas físicas no deben satisfacer este impuesto pues los sujetos pasivos del Impuesto son las personas jurídicas que detenten la propiedad de una vivienda. También aquéllas personas jurídicas que sean titulares de un derecho de usufructo, de superficie o cualquier otro derecho real que, en definitiva, les otorgue la facultad de explotación económica de la vivienda. Así pues, el próximo mes de marzo, si el Tribunal Constitucional no se ha pronunciado antes, los sujetos pasivos del Impuesto deberán presentar ante la Administración tributaria catalana, la correspondiente liquidación del Impuesto, arriesgándose en caso contrario a ser sometidos a liquidaciones complementarias, intereses de demora y/o sanciones.
