[value] => Öffentliche Auftraggeber müssen Waren, Bau- und Dienstleistungen im Wege transparenter Vergabeverfahren beschaffen. Ab Überschreiten bestimmter Schwellenwerte richten sich die Regeln für das Verfahren nach europäischem Recht. Unterhalb der Schwellenwerte gilt nationales Recht. Auch der Abschluss einer Rahmenvereinbarung ist wie ein öffentlicher Auftrag in diesem Sinne zu behandeln.
Dies ergibt sich bei Überschreiten der Schwellenwerte aus § 21 der Vergabeverordnung (VgV) und unterhalb der Schellenwerte aus § 4 VOL/A. Der Auftragswert einer Rahmenvereinbarung wird auf der Grundlage des geschätzten Gesamtwertes aller Einzelaufträge berechnet, die während der Laufzeit geplant sind, vgl. § 3 Abs. 4 VgV. Aktuell hat die Vergabekammer des Bundes entschieden, dass für das Vorliegen einer dem Vergaberecht unterfallenden Rahmenvereinbarung zusätzlich ein gesetzlich nicht geregeltes Tatbestandsmerkmal erfüllt sein muss, nämlich dass der öffentliche Auftraggeber eine Auswahlentscheidung zwischen den verschiedenen Angeboten bzw. interessierten Wirtschaftsteilnehmern vornimmt bzw. – im Falle von Rahmenvereinbarungen – zumindest eine Vorauswahl (VK Bund, Beschluss vom 12.08.2016 – VK 1-42/15). Wenn es einer unbestimmten Anzahl von Unternehmen ermöglicht wird, mit dem öffentlichen Auftraggeber eine Rahmenvereinbarung abzuschließen, liegt kein öffentlicher Auftrag im Sinne des Vergaberechts vor (im konkreten Fall ging es um den Abschluss von Rabattverträgen mit vom Auftraggeber vorgegebenen Konditionen). Liegt danach eine dem Vergaberecht unterfallende Rahmenvereinbarung mit nur einem Unternehmen vor, so werden die auf dieser Vereinbarung beruhenden Einzelaufträge entsprechend den Bedingungen der Rahmenvereinbarung vergeben. Wurde die Rahmenvereinbarung mit mehr als einem Unternehmen geschlossen, muss bei der Vergabe der Einzelaufträge eventuell ein erneutes Vergabeverfahren durchgeführt werden; Einzelheiten hierzu regelt § 21 Abs. 4 VgV.

[value] => Los poderes adjudicadores deben contratar productos, obras y servicios a través de procedimientos de licitación transparentes. Si se superan ciertos umbrales, las normas del procedimiento se rigen por el Derecho europeo. Por debajo de los umbrales se aplica el Derecho nacional. También la celebración de un acuerdo marco debe ser tratada como un contrato público en este sentido.
El valor de contratación de un acuerdo marco se calcula sobre la base del valor conjunto estimado de todos los contratos previstos durante el periodo de vigencia (cfr. art. 3, apdo. 4 VgV). Recientemente, el Tribunal administrativo federal de contratación pública (Vergabekammer des Bundes) ha resuelto que para que exista un acuerdo marco sujeto a la legislación de contratación pública debe concurrir adicionalmente un requisito de hecho no regulado legalmente, consistente en que el poder adjudicador tome una decisión de selección entre las distintas ofertas o entre los distintos operadores económicos interesados, o, en el caso de los acuerdos marco, realice al menos una preselección (Tribunal administrativo federal de contratación pública, resolución VK 1-42/15, de 12.8.2016). Si se permite a un número indeterminado de empresas celebrar un acuerdo marco con el poder adjudicador, no estaremos ante una contratación pública a los efectos de la legislación de contratación pública (en aquel caso concreto, se trataba de la celebración de contratos de descuento con condiciones preestablecidas por el adjudicador). Cuando, en ese sentido, exista un acuerdo marco sujeto a la legislación de contratación pública con una sola empresa, los contratos específicos basados en dicho acuerdo serán adjudicados conforme a las condiciones del acuerdo marco. Si se había celebrado el acuerdo marco con más de una empresa, para la adjudicación de cada contrato específico puede ser necesario celebrar un nuevo procedimiento de licitación.
