[value] => Der Rückerstattungsanspruch auf die spanische Umsatzsteuer (IVA) nach Ablauf der allgemeinen Frist zur Verrechnung von vier Jahren wurde von der Spanischen Finanzverwaltung in Zweifel gezogen. Allerdings erklärte das Spanische Tribunal Supremo mit Urteil vom 4. Juli 2007 nochmals, dass der Verlust des Anspruches des Steuerpflichtigen auf vollständige Rückzahlung der gezahlten IVA im Widerspruch zum Zweck der Steuer stehe. Daher verfällt der Anspruch auf Rückerstattung der nicht abgezogenen Überschüsse nach Ablauf der Frist von vier Jahren nicht, es kommt aber zu einem Verlust des Verrechnungsanspruches. Der Steuerpflichtige kann bei der Steuerverwaltung aber die Rückerstattung des Überschusses der IVA beantragen, die er nicht innerhalb von vier Jahren seit ihrem Anfall hat abziehen können.
Ließe man den Rückerstattungsanspruch nach Ablauf der Frist nicht mehr zu, so würde dies dem Neutralitätsgebot der IVA zuwiderlaufen und sich diese in eine tatsächliche Kostenposition für Unternehmer verwandeln. Sollte dies der Fall sein, würde es zu einer ungerechtfertigten Bereicherung der Steuerverwaltung kommen, und es würde gegen den Zweck der Steuer verstoßen.
Es handelt sich insoweit um gefestigte Rechtsprechung, so dass diese sowohl von den Finanzgerichten als auch von der Steuerverwaltung zu berücksichtigen ist. Daher muss in Fällen einer steuerlichen Überprüfung und in den in diesem Artikel beschriebenen ähnlichen Situationen die Auslegung des Tribunal Supremo beachtet werden, um eine die Rückerstattung der IVA ablehnende Entscheidung und das Anrufen höherer Instanzen zu vermeiden, was zu einer Verzögerung der Rückerstattung der von den Unternehmern gezahlten Beträge führen würde.

[value] => El derecho a la devolución del IVA, una vez transcurrido el plazo común de 4 años para su compensación, venía siendo puesto en tela de juicio por la Administración Tributaria. Sin embargo, el Tribunal Supremo ha vuelto a declarar en una sentencia de 4 de julio de 2007 que la pérdida por el sujeto pasivo del derecho a resarcirse totalmente del IVA que soportó supondría contravenir la finalidad del Impuesto. Así que transcurrido el plazo de cuatro años no hay caducidad del derecho a recuperar los excesos no deducidos, aunque sí pérdida del derecho a compensar, pero el contribuyente puede solicitar ante la Administración el exceso de cuota de IVA soportada que no ha podido deducirse en los 4 años desde su devengo.
Si se negara el derecho a la devolución del IVA una vez transcurrido el plazo para su compensación, se conculcaría el principio de neutralidad que debe regir en este impuesto, convirtiéndose el mismo es un gasto real para los empresarios. Si esto se produjera existiría un enriquecimiento injusto para la Administración tributaria, y, en definitiva, se vulneraría la finalidad misma del impuesto.
Este criterio de nuestro alto tribunal es reiterado y, por lo tanto, sienta doctrina sobre la materia, que en principio debería ser acatada tanto por los tribunales económicos administrativos, como por la Administración Tributaria. Por lo tanto, en el curso de una inspección o comprobación tributaria y en situaciones similares a la descrita en este artículo, resultaría necesario hacer valer la interpretación del Tribunal Supremo, para evitar una decisión que deniegue la devolución del IVA, y no tener así que acudir a instancias superiores que demorarían la recuperación de las cuotas pagadas por los empresarios.
