[value] => Die Entschädigung aufgrund von rechtswidriger Kündigung in Spanien hängt hauptsächlich von drei Faktoren ab:
- Lohn des Arbeitnehmers (Bruttojahresgehalt);
- Beschäftigungsdauer: zur Bestimmung der relevanten Beschäftigungsmonate des Arbeitnehmers zählt ein einziger Arbeitstag innerhalb eines Monats so, als hätte er den ganzen Monat gearbeitet;
- Art der Kündigung: Arbeitnehmer haben nur bei objektiver und rechtswidriger Kündigung ein Recht auf Entschädigung, eine rechtmäßige Kündigung berechtigt lediglich zur Schlussabrechnung.
Zur Berechnung der Entschädigung ist das Datum der Arbeitsaufnahme entscheidend:
- Wurde der Arbeitsvertrag nach dem 12. Februar 2012 abgeschlossen, beträgt die Entschädigung 33 Tageslöhne pro Beschäftigungsjahr, jedoch maximal 24 Monatseinkommen.
- Wurde der Arbeitsvertrag vor diesem Datum abgeschlossen, berechnet sich die Entschädigung wie folgt:
- für die Zeit vor dem 12. Februar 2012 beträgt die Entschädigung 45 Tageslöhne pro Beschäftigungsjahr (jedoch maximal 42 Monatseinkommen);
- für die Arbeitszeit nach dem 12. Februar 2012 beträgt die Entschädigung 33 Tageslöhne.
- beide Abschnitte werden sodann zusammengerechnet.
Die volle Entschädigung beträgt maximal 720 Tageslöhne. Ist das Ergebnis der Berechnung des ersten Abschnitts jedoch höher, gilt dieser Betrag als Höchstgrenze. Um die Beschäftigungsdauer zu berechnen, werden Arbeitsabschnitte unter einem Jahr anteilig nach Monaten verrechnet.
Im Falle einer objektiven Kündigung muss das Unternehmen dem Arbeitnehmer, zusätzlich zu dem Kündigungsschreiben, eine Entschädigung von 20 Tagen pro Beschäftigungsjahr aushändigen, die maximal 12 Monatseinkommen beträgt (keinesfalls darf die Entschädigung höher sein als der mit 12 multiplizierte Monatslohn).
La indemnización por despido en España depende de tres factores:
- Salario bruto anual del trabajador.
- Antigüedad en la empresa: A la hora de contar los meses de antigüedad del trabajador para la indemnización si se trabaja un día de un mes, es como si se hubiese trabajado el mes completo.
- Tipo de despido: Actualmente solamente tienen derecho a indemnización los despidos objetivos e improcedentes. Un despido procedente no da derecho a cobrar una indemnización, aunque sí al finiquito.
Dependiendo de la fecha de incorporación del trabajador a la empresa, el cálculo de la indemnización por despido improcedente se hará de distinta forma:
- Si el contrato fuera posterior al 12 de febrero de 2012, la indemnización será de 33 días de salario por año trabajado, con un máximo de 24 mensualidades.
- Si el contrato fuera anterior al 12 de febrero de 2012, la indemnización se calculará en dos tramos:
- Por el tiempo transcurrido hasta el 12/02/2012, siendo la indemnización 45 días de salario por año trabajado (con un máximo de 42 mensualidades)
- Por el tiempo trabajado a partir del 12/02/2012, siendo la indemnización de 33 días.
La indemnización total consta de 720 días de salario, salvo que el cálculo devengado en el primer tramo sea superior. La cuantía final de dicha indemnización se obtendrá sumando ambos tramos. La antigüedad se calcula prorrateando por meses los períodos de trabajo inferiores al año.
Cuando una empresa despide a un trabajador mediante despido objetivo debe entregarle, junto a la carta de despido, una indemnización de 20 días por año trabajado, con un máximo de 12 mensualidades (La indemnización nunca podrá superar el resultado de multiplicar el salario mensual por 12).
