[value] => Die Grundsteuer („IBI“), die auf das Eigentum an Grundstücken erhoben wird, fällt am 1. Januar eines jeden Kalenderjahres an und ist von derjenigen Person zu entrichten, die zu diesem Zeitpunkt das Eigentum an dem Grundstück innehat. Was passiert jedoch, wenn das Eigentum an dem Grundstück während des restlichen Jahres übertragen wird? Kann der Verkäufer den anteiligen Betrag, der dem Zeitraum entspricht, in welchem der Käufer das Eigentum innehat, auf nachträglich auf diesen abwälzen? Bisher war die Rechtsprechung der Landesgerichte widersprüchlich, aber nun hat der Oberste Gerichtshof in seinem Urteil vom 15. Juni 2016 diese Frage entschieden. In dem Fall hatten die Kläger im Monat März 155 Garagenstellplätze an den Beklagten veräußert. Die IBI wurde durch die Verkäufer vollständig beglichen, weshalb sie anschließend vom Käufer die Aufteilung des gezahlten Steuerbetrags für den entsprechenden Zeitraum, also von März bis Dezember des Jahres, in dem der Verkauf stattfand verlangten. Die Parteien hatten nichts im Hinblick auf die Grundsteuer vereinbart, und der Verkauf fand frei von etwaigen Belastungen statt.
Der Oberste Gerichtshof hat nun entschieden, dass im Falle einer fehlenden gegenteiligen Vereinbarung, der Verkäufer einen Teil der von ihm bezahlten Grundsteuer auf den Käufer abwälzen kann, entsprechend der Zeit, die die jeweilige Partei die Eigentümerposition innehatte. Das heißt, dass der Käufer, der sich nicht einer möglichen Forderung zur Zahlung eines Anteils der Grundsteuer ausgesetzt sehen will, von nun an im Vertrag oder der öffentlichen Urkunde ausdrücklich festhalten sollte, dass besagte Steuer vollständig von Seiten des Verkäufers übernommen wird.

[value] => El IBI, o Impuesto que grava la propiedad de los bienes inmuebles, se devenga a 1 de enero de cada año natural, por lo que el obligado al pago de dicho impuesto ante la Administración local es quién detenta la propiedad en dicha fecha. ¿Qué sucede entonces cuando la propiedad del bien inmueble se transmite durante el resto del año? ¿Puede el vendedor repercutir al comprador el importe proporcional que corresponda al tiempo en que éste último ha ostentado la propiedad? Hasta la fecha, la jurisprudencia de las Audiencias Provinciales era contradictoria pero el Tribunal Supremo, en su Sentencia de 15 de junio de 2016, ha sentado doctrina jurisprudencial, zanjando así el debate. En el supuesto enjuiciado, los demandantes habían vendido a la demandada 155 plazas de garaje en el mes de marzo. El IBI del ejercicio fue íntegramente abonado por los vendedores pero éstos, con posterioridad, solicitaron a la compradora el prorrateo de la cuota tributaria correspondiente al período impositivo del año en que se produjo la venta –esto es, de marzo hasta diciembre-. Las partes nada habían pactado respecto a la cuota del IBI y la compraventa se había producido libre de cargas y gravámenes.
El Tribunal Supremo, en efecto, ha establecido que, en caso de ausencia de pacto en contrario, el vendedor que abone el IBI podrá repercutirlo sobre el comprador, en proporción al tiempo en que cada una de las partes haya ostentado la titularidad dominical y por el tiempo que lo posea. Es decir, a partir de ahora, si el comprador no desea verse expuesto a una posible reclamación de cantidad por la parte proporcional del IBI, el contrato y/o la escritura pública deberán reflejar con meridiana claridad que dicho Impuesto será abonado por la parte vendedora.
