[value] => In der Präambel der Berufsordnung der spanischen Anwaltschaft, welche die Ausübung der Tätigkeit eines Anwalts regelt, wird festgelegt, dass diese Tätigkeit u.a. mit Würde, Integrität und Professionalität ausgeübt werden muss. Vor Jahren wurde aus diesem Grund die Werbung in diesem Bereich der Anwaltschaft als unwürdig und unehrlich angesehen. Daher war für diesen Bereich die Werbung sehr beschränkt. Bis vor einiger Zeit war die einzige Möglichkeit der Direktwerbung, das Anbringen eines Schildes an dem Gebäude der Kanzlei.
Seit den 80er Jahren bis zum Jahr 2001 war die Werbung für die Rechtsanwälte gem. der Statuten der Anwaltschaft verboten. Dieses Verbot wurde damit begründet, dass in dieser Zeit davon ausgegangen wurde, dass die Werbung anwaltlicher Dienstleistungen mit der Vertrauenswürdigkeit des Berufs unvereinbar sei. Durch die Änderungen kam es in dem Bereich der Anwaltschaft zur Liberalisierung der Werbung und einige Einschränkungen wurden aufgehoben. In der Vergangenheit mussten sich die Rechtsanwälte in ihren Kanzleien verstecken und auf den Mandanten warten, da Werbung praktisch verboten war. Heutzutage können wir beobachten, wie die Werbung in diesem Bereich mittlerweile akzeptiert wird, so dass früher fast von einer „Zensur“ ausgegangen werden konnte und heute „alles möglich“ ist.
Aufgrund der Verbreitung der neuen Technologien und folglich der Nutzung der sozialen Netzwerke, der Websites und des Ausmasses dieser Medien in Bezug auf die Nutzer, ist eine Regulierung und Kontrolle notwendig, und nicht nur bezüglich der konventionellen Werbung, sondern insbesondere bezüglich der Werbung, die „online“ angeboten wird.

[value] => En el Preámbulo del Código Deontológico de la Abogacía Española que regula el ejercicio de la profesión del abogado se establece que ésta tiene que ser ejercida con dignidad, integridad y un servicio profesional, entre otros. Por eso hace años utilizar la publicidad en el sector de la abogacía se concebía como un acto indigno y deshonesto, por ello, para este sector estaba muy limitada la publicidad. Hasta hace poco la única forma de hacer publicidad directa era poner una placa en la fachada del edificio donde se encontraba el despacho.
Desde los años 80 hasta el año 2001 existía en el Estatuto General de la Abogacía una prohibición de la publicidad hacia los abogados. Esta prohibición tenía su justificación porque en aquella época se entendía que realizar un mensaje publicitario ofreciendo servicios jurídicos, era totalmente incompatible con la seriedad de esta profesión. Los cambios llegaron y se empezó a liberalizar la publicidad en el sector de la abogacía y a levantar ciertas restricciones. Y si en el pasado, los abogados tenían que estar escondidos en los despachos esperando la llamada de un cliente porque no se permitía prácticamente ninguna forma de publicidad, actualmente podemos observar como la publicidad está totalmente aceptada en este sector, pasando casi de una “censura” a un “todo vale”.
Debido a la penetración de las nuevas tecnologías y, por consiguiente, al uso de las redes sociales, páginas webs y el alcance que tienen estos medios para todos los usuarios, es imprescindible empezar a regular y controlar, no solamente la publicidad convencional, sino también la publicidad que se puede llegar a realizar en los diferentes medios “online” y el formato de éstos.
