[value] => In einem interessanten Urteil hat sich das Oberlandesgericht (OLG) Frankfurt a. M. zu der Frage geäußert, unter welchen Voraussetzungen die Klageerhebung vor einem ausländischen Gericht die Verjährung im Sinne deutschen Sachrechts hemmt. Geklagt hatte ein deutscher Inhaber von argentinischen Staatsanleihen auf Rückzahlung und Zahlung von Zinsen. Das OLG hatte sich dabei zunächst mit der Frage auseinanderzusetzen, ob der argentinische Staat, als Schuldnerin und Beklagte, durch Notstandsgesetze die Zahlungen aus den Anleihen aussetzen konnte. Ein lesenswerter längerer Abschnitt befasst sich dabei mit der Frage, ob es einen Eingriff in (ungeschriebene) völkerrechtliche Grundsätze bedeutet, wenn ein deutsches Gericht diese Notstandsgesetze – wegen der eigentlichen Anwendbarkeit deutschen Rechts und nach herkömmlichen Regeln des Internationalen Privatrechts – außer Acht lässt.
Nachdem es das verneint hat, dem Kläger also grundsätzlich einen Anspruch trotz der argentinischen „Staatspleite“ zugesteht, beschäftigt es sich mit der prozessrechtlichen Frage, ob die vorhergehende Klage in Argentinien die Verjährung gehemmt hat. Wegen dieser selten aufgeworfenen Fragestellung rekurriert das Gericht sogar auf die Auffassung des Reichsgerichts aus dem Jahre 1930. Das muss nicht verwundern. Das Bürgerliche Gesetzbuch stammt immerhin aus dem Jahre 1896. Es bestimmt im – allerdings zwischenzeitlich modifizierten - § 204 BGB, dass die Rechtsverfolgung die Verjährung hemmt. Das Reichsgericht hatte noch die Ansicht vertreten, dass eine Klage vor einem ausländischen Gericht die Verjährung aber nur dann hemmt, wenn gleichzeitig die Anerkennung des ausländischen Urteils in Deutschland gesichert sei. Das ist nach § 328 I Nr. 5 ZPO aber nicht der Fall, wenn „die Gegenseitigkeit nicht verbürgt ist“, also wenn der ausländische Staat die deutschen Urteile nicht anerkennt. Das OLG fand aber für diese Sicht weder im Wortlaut noch im Sinn und Zweck der Norm Anhaltspunkte und befand § 204 BGB für anwendbar, hat also die Hemmungswirkung bejaht.

[value] => En una interesante sentencia, la Audiencia Territorial (Oberlandesgericht) de Frankfurt am Main se ha manifestado en relación a la cuestión de bajo qué condiciones la interposición de una demanda ante un juzgado extranjero frena la prescripción en el sentido del Derecho material alemán. Un alemán, titular de bonos del estado de Argentina, había reclamado el reembolso y pago de intereses. El Oberlandesgericht tuvo primero que abordar la cuestión de si el Estado argentino, como deudor y demandado, en aplicación de leyes de estado de excepción, podía suspender el pago derivado de los bonos. Un largo párrafo digno de lectura resume la cuestión de si se contravienen los principios de Derecho internacional (no escritos) en el caso de que un juzgado alemán prescinda de esta normativa del estado de excepción – por aplicación del Derecho alemán y de las convencionales normas del Derecho internacional privado.
Tras haberlo denegado, y, por lo tanto, tras haber admitido al demandado el derecho de reclamación a pesar del impago de la deuda pública argentina, el Oberlandesgericht se dedicó a analizar la cuestión procesal de la suspensión de la prescripción por la demanda que antes se había presentado en Argentina. Debido a que es una cuestión raramente planteada, el Oberlandesgericht tuvo que recurrir incluso a la interpretación del Tribunal Supremo del Reich (Reichsgericht) del año 1930. Ello no debe sorprender a nadie, pues el Código civil alemán es de 1896. Se dispone en el – ínterin modificado - art. 204 que se detiene la prescripción por cualquier acción judicial.
El Reichsgericht defendía no obstante la postura de que una demanda ante cualquier Juzgado extranjero sólo suspende la prescripción si al mismo tiempo se asegura el reconocimiento de la sentencia extranjera en Alemania. Esto no sucede, según el art. 328 I núm. 5 del Código procesal civil, si el estado extranjero no reconoce la sentencia alemana. El Oberlandesgericht no ha encontrado justificado este punto de vista y ha considerado el art. 204 como aplicable.
