[value] => Im Falle einer Kündigung aus objektiven Gründen muss der Arbeitgeber die Entscheidung vor einem Richter begründen.
Gemäß Art. 53 des spanischen Arbeitnehmergesetzes muss zudem folgendes Verfahren eingehalten werden:
- Zugang des Kündigungsschreibens, welches das Datum des Vertragsendes und die Kündigungsbegründung enthält, beim Arbeitnehmer;
- Zahlung einer Entschädigung, die sich aus 20 Tagen pro Jahr der Betriebszugehörigkeit des zustehenden Gehalts ergibt und maximal 12 Monatsgehälter betragen darf;
- Eine Mitteilung an den Arbeitnehmer fünfzehn Tage vor Ende des Arbeitsverhältnisses; im Falle der Säumnis dieser Frist muss das Gehalt für diese Tage ausgezahlt werden.
Die Nichteinhaltung dieser Vorschriften kann zur Unrechtmäßigkeit der Kündigung führen. In diesem Fall steht dem Arbeitgeber ein Wahlrecht zu: er kann eine Entschädigung zahlen oder den Arbeitnehmer wieder einstellen (einschließlich der rückwirkenden Zahlung des Gehalts).
Die Entschädigung für die objektive Kündigung berechnet sich in Spanien anhand des Gehalts von 20 Tagen, wobei das letzte Monatsgehalt maßgebend ist, multipliziert mit der Anzahl der Dienstjahre. Außer-ordentliche Zahlungen werden dabei anteilig angerechnet. Die Dienstjahre berechnen sich nach vollen Monaten ab dem Beginn der Arbeitsbeziehung (auch bei Arbeitsbeziehungen durch Zeitarbeit, Ausbildung oder Leiharbeit). Die Entschädigung ist in der Höhe auf 12 Monatsgehälter beschränkt.
Das Kündigungsschreiben muss die gewählte Option des Arbeitgebers eindeutig festlegen. Die Kündigung kann für unrechtmäßig erklärt werden, wenn die Entschädigung zum Zeitpunkt des Zugangs des Kündigungsschreibens (spätestens zum Zeitpunkt des Wirksamwerdens der Kündigung) nicht oder nicht korrekt gezahlt wurde.

- Justificar las causas, para que en caso de su impugnación, el Empresario pueda acreditar la realidad de los hechos ante el juez con el fin de evitar que el despido sea declarado improcedente.
- Seguir el siguiente procedimiento recogido en el art. 53 del Estatuto de los
Trabajadores:
- Entrega de una carta de despido al trabajador: en la que deberá figurar tanto la fecha de efecto del despido, como una descripción de los hechos que motivan la extinción de la relación laboral.
- Entregar junto con la carta y en el mismo momento al trabajador una indemnización calculada a razón de 20 días de salario por año trabajado con un máximo de 12 mensualidades.
- Preaviso de quince días de antelación a la fecha de efecto del despido, o en su defecto, el abono de esos días en el finiquito.
- En caso de que la Empresa tenga representantes de los trabajadores, el Empresario deberá darles traslado de una copia de la comunicación extintiva.
De no cumplirse el procedimiento, el despido podrá considerarse improcedente. Las consecuencias serán a elección de la empresa y, salvo supuestos especiales, consistirán o bien en el pago de una indemnización, o bien en la reincorporación del trabajador a su puesto de trabajo.
La indemnización por despido objetivo en España es de 20 días por año trabajado con un máximo de 12 mensualidades. La cuantía de la indemnización dependerá de dos factores: la antigüedad del trabajador en la empresa y su salario. La antigüedad se calcula por meses completos y se tiene en cuenta desde el inicio de la relación laboral. El salario regulador a efectos de la indemnización será, salvo supuestos especiales, el percibido durante el último mes prorrateado con las pagas extras.
La carta de despido debe cuantificar la indemnización sin que el trabajador tenga que hacer un trámite complementario. El despido podrá ser declarado improcedente si la indemnización no se abona en el mismo momento de la entrega de la carta de despido.
