[value] => Zum zehnjährigen Bestehen des Allgemeinen Gleichbehandlungsgesetzes (AGG) hat der Europäische Gerichtshof (EuGH) im Rahmen eines Vorlageverfahrens des Bundesarbeitsgerichts (BAG) am 28. Juli 2016 ein aus Unternehmersicht interessantes Urteil – Rs. C-423/15 – erlassen. Zunächst zum vereinfacht dargestellten Sachverhalt: Der Kläger ist Volljurist und seither überwiegend als selbstständiger Rechtsanwalt tätig gewesen, laut Bewertung auch eine Zeit lang als leitender Angestellter einer Rechtsschutzversicherung. Er hat schon viele Unternehmen und mehrere Anwaltskanzleien auf Entschädigungen wegen Altersdiskriminierung verklagt. Unter anderem hat er sich auf eine Stellenausschreibung für die Fachrichtung Jura eines großen Versicherungskonzerns beworben. Darin wurde ein nicht länger als ein Jahr zurückliegende Hochschulabschluss und qualifizierte Berufserfahrung verlangt. Der Kläger – damals 38 Jahre alt – war abgelehnt worden. Er verlangte daraufhin Entschädigung wegen Altersdiskriminierung. Eine nachfolgende Einladung zum Vorstellungsgespräch lehnte er ab. Als der Kläger erfuhr, dass die vier Stellen ausschließlich mit Frauen besetzt worden waren, forderte er eine zusätzliche Entschädigung aufgrund von Geschlechterdiskriminierung.
Der EuGH hat die Frage, ob Diskriminierungsschutz auch für solche Scheinbewerbungen gilt, verneint und damit die Auffassung des BAG bestätigt. Die dem AGG zu Grunde liegende EU-Richtlinien wollen Personen schützen, die Beschäftigung suchen. Wenn jemand eine Bewerbung einreicht, um ausschließlich den formalen Status als Bewerber zu erlangen, könne er sich auf den Schutz der Richtlinien daher nicht berufen – so der EuGH. Ein Scheinbewerber könne daher auch keine Entschädigung wegen Diskriminierung verlangen. Jedoch ist aus Unternehmersicht Vorsicht geboten, nach den Ausführungen des EuGH vorschnell auf eine Scheinbewerbung und missbräuchliches Verhalten zu schließen. Für deren Annahme bedarf es klarer objektiver Anhaltspunkte.

[value] => Cumpliéndose el décimo aniversario de la Ley alemana de Igualdad de Trato (AGG), el Tribunal de Justicia de la Unión Europea (TJCE) emite su sentencia de 28 de julio de 2016 (C-423/15), sentencia de gran interés desde la perspectiva del empleador. Primero un breve resumen de los hechos: La parte demandante es jurista, ejerciendo principalmente como abogado. Había denunciado ya a numerosos bufetes de abogados y empresas por discriminación por razón de edad. Presentó su candidatura a un puesto de trabajo en el seno de una gran aseguradora, para el que se requería haber recibido un título de estudios superiores en derecho hace no más de un año y contar con la experiencia profesional pertinente. El demandante vio su candidatura rechazada, por lo cual decidió interponer una demanda exigiendo compensación por discriminación por razón de edad, e incluso rechazó una invitación posterior para acudir a una entrevista con la empresa. Al enterarse después que los cuatro puestos habían sido otorgados todos a mujeres, extendió su reclamación para incluir discriminación por razón de género.
El TJCE confirmó con su sentencia la posición de los tribunales alemanes, a saber, que candidatos de mala fe no pueden buscar amparo en la normativa de anti-discriminación. Las Directivas europeas, sobre las que la AGG sienta sus fundamentos, buscan asegurar la protección de personas en búsqueda de empleo. Ahora bien, la TJCE deniega cualquier protección a aquellos candidatos que presenten candidaturas a puestos de trabajo con el único objetivo de adquirir justamente ese estatus formal de candidato. Un candidato de mala fe queda así desprovisto de cualquier derecho a exigir una compensación por discriminación. Ahora bien, desde el punto de vista empresarial, conviene ir con cuidado de no precipitarse a calificar a determinados candidatos como candidaturas abusivas o de mala fe; sólo puede llegarse a tal conclusión tras una cuidadosa evaluación de indicios objetivos.
