[value] => Ende August hat das Bundeskabinett den Gesetzesentwurf zur Einführung beruflicher Zulassungsregelungen für Immobilienmakler und Wohnungseigentumsverwalter beschlossen. Mit dem Gesetzentwurf werden eine Verbesserung der von Immobilienmaklern und Wohnungseigentumsverwaltern erbrachten Dienstleistungen und eine Stärkung des Verbraucherschutzes angestrebt. Der Dachverband Deutscher Immobilienverwalter (DDIV) rechnet mit einer Verkündung des Gesetzes spätestens im ersten Quartal 2017, wobei die Berufszulassungsregelungen erst Ende 2017 in Kraft treten dürften.
Für Immobilienmakler werden die Erlaubnisvoraussetzungen verschärft, indem ein Sachkundenachweis verlangt wird. Für Wohnungseigentums-verwalter wird erstmals eine Erlaubnispflicht in der Gewerbeordnung eingeführt. Voraussetzung für die Erlaubniserteilung ist neben der erforderlichen Zuverlässigkeit und geordneten Vermögens-verhältnissen auch eine verbindliche Sachkundeprüfung. Mit der darüber hinaus im Gesetzentwurf vorgesehenen Einführung einer Berufshaftpflichtversicherung für Wohnungseigentumsverwalter sollen Wohnungseigentümer vor finanziellen Schäden geschützt werden, die durch die fehlerhafte Berufsausübung des Wohnungseigentumsverwalters entstehen können.
Die Sachkundeprüfung für gewerbliche Wohnungseigentumsverwalter und Immobilienmakler, die in den letzten sechs Jahren vor Verkündung des Gesetzes ununterbrochen am Markt tätig sind, soll entfallen. Eine Befreiung gilt auch für sich selbstverwaltende Eigentümergemeinschaften und für die nicht gewerbsmäßige Verwaltung durch einen Mieteigentümer.
Nach dem Gesetzesentwurf haben Immobilienmakler und Wohnungseigentumsverwalter die Pflicht, die Qualifikation seiner Mitarbeiter aktiv zu prüfen.

[value] => El Consejo Federal de Ministros alemán aprobó a finales de agosto un proyecto de ley que regula el acceso a la profesión de los agentes inmobiliarios y los administradores de fincas. Con este proyecto de ley, se persigue una mejora de los servicios prestados por estos profesionales y un incremento de la protección de los consumidores. La asociación de administradores de fincas (DDIV en sus siglas en alemán) cuenta con una promulgación de la ley durante el primer trimestre de 2017 como muy tarde y con una entrada en vigor de los requisitos de acceso a la profesión a finales de 2017.
Para los agentes inmobiliarios se incrementan los requisitos para la obtención de una licencia de actividad, exigiéndose ahora superar un examen especializado. Para los administradores de fincas es necesario por primera vez la obtención de una licencia de actividad de acuerdo con la reglamentación del comercio y la industria. Requisito previo para conceder la licencia de actividad es, además de la necesaria fiabilidad y situación financiera estable de la persona, también la obligación de superar un examen que documente conocimientos en la materia. Además, los administradores de fincas tienen que contratar un seguro de responsabilidad civil profesional, lo que protegerá a los propietarios de viviendas de daños económicos que pudieran derivarse de errores del administrador.
El examen de conocimientos no será necesario para los administradores de fincas con carácter comercial y los agentes inmobiliarios que hayan trabajado ininterrumpidamente durante los seis años anteriores a la promulgación de la ley. También estarán exentas las comunidades de propietarios que se administren a sí mismas, así como la administración sin carácter comercial llevada a cabo por un copropietario.
Según el proyecto de ley, los agentes inmobiliarios y administradores de fincas tienen la obligación de comprobar activamente la cualificación de sus empleados.
