[value] => Gemäß des Urteils des Tribunal Supremo vom 15. Januar 2015 ist ein Time-Sharing Vertrag nichtig, wenn die Beschreibung des zu nutzenden Objekts sowie der genaue vereinbarte Nutzungszeitraum nicht hinreichend bestimmt sind. In dem Urteil wird ausgeführt, dass im Grundbuch das Nutzungsrecht der vertragsgegenständlichen Wohneinheit unter Angabe der Tage und Stunden, an denen das Nutzungsrecht besteht, genau zu bezeichnen ist. Dies ergibt sich aus Art. 1.7. und 9.1. des Gesetzes 42/1998. Ein Verstoß hat die Nichtigkeit des gesamten Vertrags zur Folge. Dieser ist dann gegen Rückgewährung der jeweils empfangenen Leistungen rückabzuwickeln.
Ein weiteres bedeutsames Urteil des Tribunal Supremo vom 9. Dezember 2015 regelt die Nutzung von Gemeinschaftseigentum im Erbfall. Bis zur vollständigen Erbauseinandersetzung war es bisher so, dass die Nutzung einer ererbten Immobilie nur durch einzelne Miterben bis zu deren Veräußerung im Rahmen der Erbauseinandersetzung nicht möglich war. Nach dieser neuen höchstgerichtlichen Entscheidung kann die aufeinanderfolgende und wiederholte Nutzung einer ererbten Immobilie durch nur einzelne Miterben eine gerechte Nutzungsweise des Gemeinschaftsguts darstellen, sofern eine gemeinschaftliche oder gleichzeitige Nutzung ausgeschlossen ist oder ein Miterbe eine solche Nutzung beantragt.

[value] => Según una sentencia del Tribunal Supremo, de 15 de enero de 2015, un contrato de Time-Sharing será nulo si en él no se han detallado de forma suficiente el objeto del contrato y el periodo exacto de uso del mismo. En la sentencia se establece también que en el registro de la propiedad deberá quedar lo suficientemente detallado el derecho de aprovechamiento de la vivienda objeto del contrato, haciéndose indicación de los días y horas en los que se tiene este derecho de aprovechamiento. El incumplimiento de estos requisitos implica la nulidad de todo el contrato, debiéndose restituir a las partes las prestaciones recibidas.
Otra importante sentencia del Tribunal Supremo, de fecha 9 de diciembre de 2015, regula la utilización de una propiedad común en caso de herencia. Previo al reparto completo de la herencia no era, hasta la fecha, posible la utilización de una vivienda heredada por parte de tan solo uno de los coherederos, por lo que había que esperar a la venta de la misma, en el marco de la liquidación de la herencia para poder utilizar la vivienda. Sin embargo, a raíz de la citada sentencia, la utilización sucesiva y reiterada de una vivienda heredada por parte de coherederos individuales puede constituir ahora una fórmula equitativa de utilización de la propiedad común, siempre y cuando no sea posible una utilización conjunta o simultanea o que un coheredero hubiera solicitado tal utilización.
