[value] => Ein Werbespot eines Autovermieters wird in Spanien zurzeit als ein Skandal betrachtet. Dieser „Spot“ zeigt unter dem Motto „Spanien gefallen die Deutschen“ eine junge sinnliche Frau im Bikini, die einen älteren, übergewichtigen und nicht gerade gutaussehenden Mann verführt, um sein Auto zu behalten. Die Verbraucherschutzorganisation (FACUA) hat den Autovermieter „Sixt“ bei der Staatsanwaltschaft in Valencia aufgrund des Verstosses gegen das Gesetz über die Werbung in Verbindung mit dem Gesetz der Massnahmen zum Schutz gegen die geschlechtsbezogene Gewalt, angezeigt.
Art. 3 des Gesetzes über die Werbung hält die Werbung, die Menschen aufgrund ihres Geschlechts diskriminiert für rechtswidrig, wobei diese Praktiken normalerweise nicht bestraft werden. Dies liegt daran, dass die zentralen und regionalen Verbraucherschutzbehörden zwar solche Anzeigen an die öffentlichen Einrichtungen weiterleiten, die die Rechte und Chancengleichheiten der Frauen schützen, doch obwohl sich diese Einrichtungen über diese Themen bewusst sind, verfügen sie nicht über eine Sanktionsbefugnis, um solch gravierende Verstösse zu bestrafen.
Laut FACUA verstösst diese Werbespot auch gegen Art. 10 des Gesetzes der Massnahmen zum Schutz gegen die geschlechtsbezogene Gewalt, welcher vorsieht, dass die Werbung als rechtwidrig gilt, wenn diese diskriminierende oder beleidigende Handlungen gegenüber der Frau zeigt. Ebenso verstösst dieser Spot gegen Art. 41 des Gesetzes für die tatsächliche Gleichstellung der Frauen und Männer, welcher besagt, dass Werbung, die ein diskriminierendes Verhalten im Sinne dises Gesetzes zeigt, als rechtswidrig gilt. Die Staatsanwaltschaft wird nun die entsprechenden Massnahmen treffen, die auch Auswirkungen auf andere Werbetreibenden haben können.

El ‘spot’ muestra a una mujer joven y voluptuosa en bikini que seduce a un hombre mayor, con sobrepeso y poco agraciado físicamente para quedarse con su coche, bajo el lema ‘A España le encantan los alemanes’. La Asociación de Consumidores (FACUA) ha denunciado a “Sixt” ante la Fiscalía de Valencia por vulnerar la Ley General de Publicidad en relación con la Ley de Medidas de Protección Integral contra la Violencia de Género.
El artículo 3 de la Ley General de Publicidad considera ilícitos los anuncios que atenten contra la dignidad de la persona en función de su sexo, pero estas prácticas no suelen ser objeto de sanción. Y es que las administraciones centrales y autonómicas competentes en materia de Consumo suelen limitarse a derivar estas denuncias a los organismos públicos dedicados a la defensa de la igualdad de la mujer, muy concienciados sobre la problemática denunciada pero carentes de potestad sancionadora frente a estas graves irregularidades.
Asimismo, FACUA argumenta que el anuncio contraviene el artículo 10 de la Ley de Medidas de Protección Integral contra la Violencia de Género que en lo relativo al ámbito de la publicidad y de los medios de comunicación señala que “se considerará ilícita la publicidad que utilice la imagen de la mujer con carácter vejatorio o discriminatorio”. También incumple el artículo 41 de la Ley Orgánica para la igualdad efectiva de mujeres y hombres, que recoge que “la publicidad que comporte una conducta discriminatoria de acuerdo con esta Ley se considerará publicidad ilícita”. Será ahora la Fiscalía la que deberá tomar medidas que pueden afectar a otros anunciantes.
