[value] => Die Generaldirektion für Abgaben (DGT) analysiert in Beantwortung des rechtsverbindlichen Auskunftsantrags V0811-16, de 01 vom 1. März 2016 die Besteuerung von Weinflaschen, die eine Weinherstellung- und Abfüllungsfirma kostenlos an ihre potenziellen Kunden verteilte.
In diesem Antwortschreiben kommt die DGT zu dem Schluss, dass die kostenlos verteilten Weinflaschen in der Körperschaftsteuer als von dem Auskunftsantragssteller zur Verkaufsförderung seiner Produkte getätigte Ausgaben anzusehen sind, weshalb sie steuerlich absetzbar sind, sofern alle Anforderungen im Hinblick auf deren Verbuchung, Anfall und Belegdokumente erfüllt sind.
Im Gegensatz dazu, und was die Mehrwertsteuer anbelangt, begründet dieselbe kostenlose Verteilung jedoch eine Lieferung von Gütern, die einer mehrwertsteuerpflichtigen und nicht mehrwertsteuerfreien Lieferung von Gütern gleichgestellt ist, weshalb die Firma die jeweils entsprechende Rechnung ausstellen und den entsprechend geschuldeten Mehrwertsteuerbetrag in der regelmäβig vorzulegenden Mehrwertsteuererklärung angeben muss.

[value] => La Dirección General de Tributos en su contestación a la consulta vinculante V0811-16, de 01 de marzo de 2016, analiza la fiscalidad de la entrega gratuita de botellas de vino por parte de una empresa dedicada a la elaboración y embotellado de vinos a sus clientes potenciales.
En dicha contestación la DGT concluye que en el Impuesto sobre Sociedades las entregas gratuitas de botellas de vino a clientes potenciales se entienden gastos realizados para promocionar las ventas de la entidad consultante, por lo que serán fiscalmente deducibles siempre que cumplan los requisitos en términos de inscripción contable, devengo y justificación documental.
Por el contrario, en el IVA, la misma entrega a título gratuito constituye la realización de una operación asimilada a una entrega de bienes que se encuentra sujeta y no exenta del IVA, por lo que la empresa debe expedir la oportuna factura y consignar el importe de la cuota devengada correspondiente en la declaración-liquidación periódica del IVA.
