[value] => Eines der größten Probleme, die ein Gläubiger antrifft, wenn er eine offene Forderung eintreiben möchte, ist die effiziente Vollstreckung. Es kommt häufig vor, dass nach Erstreiten eines Urteils kein Vermögen des Schuldners für die Befriedigung der Forderung vorgefunden wird. In Anbetracht dieser Schwierigkeiten und der Nachteile, die dadurch im Rechts- und Handelsverkehr entstehen, und um dem Gläubiger ein nützliches Instrument für die Eintreibung seiner Forderung zur Verfügung zu stellen, hat die Europäische Union die Verordnung Nr. 655/2014 zur Einführung eines Verfahrens für einen Europäischen Beschluss zur vorläufigen Kontenpfändung erlassen.
Die erwähnte Verordnung, die ab Anfang 2017 gilt, erlaubt dem Gläubiger einen Europäischen Beschluss zur vorläufigen Kontenpfändung zu beantragen und zu erhalten, um zu verhindern, dass die Vollstreckung seiner Forderung dadurch gefährdet wird, dass Gelder, die vom Schuldner oder in seinem Namen auf einem in einem Mitgliedstaat geführten Bankkonto gehalten werden, überwiesen oder abgehoben werden.
Der Antrag auf Erlass eines Beschlusses zur vorläufigen Pfändung kann sowohl von einem Gläubiger, der bereits eine gerichtliche Entscheidung, einen gerichtlichen Vergleich oder eine vollstreckbare öffentliche Urkunde erwirkt hat, gestellt werden, als auch von einem Gläubiger, der noch kein Verfahren gegen den Schuldner eingeleitet hat, der aber wünscht, die Vollstreckung einer zukünftigen Entscheidung zu sichern. Verständlicherweise sorgen bestimmte Regeln dafür, dass von diesem Instrument kein Missbrauch gemacht wird, wie z.B. die Sicherheitsleistung des Gläubigers und die Haftung des Gläubigers für etwaige Schäden, die dem Schuldner durch den Beschluss zur vorläufigen Pfändung entstehen.
Unseres Erachtens handelt es sich um ein nützliches Rechtsinstrument für die immer schwierige Vollstreckung von Forderungen.

[value] => Uno de los principales problemas con los que se enfrenta un acreedor a la hora de reclamar una deuda impagada es la posibilidad real o no de recuperar todo o al menos parte del importe reclamado. En no pocas ocasiones nos encontramos con que, tras ver reconocido su crédito por una resolución judicial, el deudor carace de bienes con los que satisfacer el legítimo crédito del acreedor. Consciente de dichas dificultades y de los perjuicios que ello genera en el tráfico jurídico y comercial y, como medio para dotar al acreedor de una herramienta que puede resultar útil en su intento de cobrar su crédito, la Unión Europea aprobó el Reglamento 655/2014, de 15 de mayo, por el que se establece el procedimiento para conseguir una orden europea de retención de cuentas de un deudor.
Dicho Reglamento, que se comenzará a aplicar a principios de 2017, permitirá al acreedor solicitar y obtener una orden europea de retención de cuentas bancarias que el deudor, u otra persona por cuenta de éste, posea en un Estado miembro, de tal forma que se evite que el deudor pueda disponer libremente de dichos fondos (mediante una retirada o transferencia), poniendo así en peligro la satisfacción de su crédito.
Se encuentran legitimados para solicitarla tanto el acreedor que ya disponga de una resolución judicial, transacción judicial o documento público con fuerza ejecutiva a su favor como aquel que aún no haya iniciado el procedimiento correspondiente pero pretenda asegurar la ejecución de una futura resolución judicial favorable. Como es lógico, se establecen también determinadas garantías para evitar un uso indebido de dicho mecanismo, como la necesaria prestación de caución por parte del acreedor y su responsabilidad por los daños y perjuicios que la retención le pueda causar al deudor.
Se trata, en nuestra opinión, de una herramienta útil en la siempre difícil tarea de lograr el pago de una deuda.
