[value] => Das Leistungsniveau der gesetzlichen Rentenversicherung sinkt aufgrund der Überalterung der Bevölkerung immer weiter. Damit steigt die Bedeutung einer betrieblichen Altersversorgung (bAV), die verschiedene Handlungsoptionen für Arbeitgeber und Arbeitnehmer bereithält. Es wird zwischen der arbeitnehmer- und der arbeitgeberfinanzierten bAV unterschieden.
Im ersteren Fall gibt der Arbeitgeber dem Arbeitnehmer mit Angeboten zur Entgeltumwandlung die Möglichkeit, die Vorteile der bAV, insbesondere die günstigeren Tarife der Gruppenversicherung gegenüber den Tarifen für individuelle Lebensversicherungen und die fehlende oder eingeschränkte Gesundheitsprüfung zu nutzen. Diese Form der bAV belastet den Arbeitgeber in geringerem Maße. Es kann durchaus in beiderseitigem Interesse liegen, derartige Vorschläge zur Entgeltumwandlung zu machen. Der Arbeitnehmer hat jedoch nur die Alternative, entweder das Angebot anzunehmen oder es abzulehnen und damit auf eine bAV zu verzichten.
Bei der ganz oder zumindest in erheblichem Umfang arbeitgeberfinanzierten bAV wird der Arbeitgeber zunächst überlegen, wem er diese zugutekommen lassen möchte: allen Mitarbeitern oder nur einem Teil der Belegschaft. So hat er die Möglichkeit, die aus seiner Sicht besonders wichtigen Arbeitnehmer durch eine Betriebsrentenzusage enger an sein Unternehmen zu binden. Hierfür bedarf es der Ausgestaltung einer in der Regel komplexen Versorgungsordnung, die Diskriminierungsverbote und Gleichbehandlungsgebote zu berücksichtigen hat. Manche Arbeitgeber werden gar eine Kombination aus arbeitnehmer- und arbeitgeberfinanzierter bAV in Betracht ziehen: die Entgeltumwandlung für alle Mitarbeiter und die Zusage einer arbeitgeberfinanzierten Betriebsrente nur für besonders wichtige Arbeitnehmer. Es besteht also ein umfangreicher Gestaltungsspielraum, den es unter Berücksichtigung der unternehmensspezifischen Situation im Einzelfall auszuschöpfen gilt.

Este fenómeno subraya la importancia de encontrar una compensación adecuada mediante planes de pensiones empresariales que ofrecen diferentes opciones al alcance de la compañía y del empleado. Es necesario, en primer lugar, hacer la diferencia entre el plan de pensiones que financia el empleado y el que es financiado por la compañía.
En el primer caso, puede conceder la compañía al empleado la oportunidad de aprovechar las ventajas que ofrece el mecanismo de conversión de parte del salario del empleado en aportaciones, accediendo el empleado así a las tarifas más económicas que ofrecen los contratos de seguro de vida de grupo frente a los seguros individuales. Esta versión del plan de pensiones representa una solución más bien económica para la compañía. Es más, las ventajas del mecanismo de la conversión de salario en aportaciones o cotizaciones merecen ser consideradas por ambas partes. Por su parte, el empleado no puede sino aceptar o rechazar la oferta de la compañía a tal respecto, quedándose en este último caso fuera del plan de pensiones. Por parte, sin embargo, del plan de pensiones financiado por la compañía, ésta se va a plantear a quién quiere ofrecer la oportunidad de aprovecharse del mismo: a todos sus empleados o sólo a parte del personal. De esta manera, puede ligar a los empleados más estrechamente a la compañía.
Ahora bien, para ello hace falta elaborar un complejo régimen contractual que excluya cualquier discriminación y asegure la igualdad de trato. Algunas compañías optan incluso por mecanismos que combinan los dos tipos de planes de pensiones, ofreciendo a todo el personal acceso a la conversión de salario en aportaciones para un seguro de vida, junto con la concesión de un plan de pensiones empresarial para empleados destacados. Existe pues un gran margen de flexibilidad de regulación dependiendo de las circunstancias e intereses de cada empresa.
