[value] => In Übereinstimmung mit Artikel 10.3 des spanischen Körperschaft-steuergesetzes („LIS“) und der 9. Bewertung der in Spanien gelten-den Allgemeinen Rechnungslegungs- und Bilanzierungsvorschriften („PGC“), muss das Buchergebnis des Verkaufs von Bezugsrechten in die Bemessungsgrundlage des Unternehmens aufgenommen werden, das solche Rechte veräußert.
Die Generaldirektion für Abgaben („DGT“) setzt in ihrer am 13. November 2015 verbindlich erteilten Rechtsauskunft, in der sie eine abschließende Auslegung des Artikels 21 des LIS vornimmt, fest, dass die in genanntem Artikel 21 geregelte Steuerbefreiung, - selbst wenn der sich aus der Veräußerung von Bezugsrechten ergebende Erlös weder dem Bezug von Dividenden, die von einer beteiligten Gesellschaft ausgeschüttet werden, noch der Übertragung der an dieser gehaltenen Beteiligung entspricht -, auf diesen Erlös in Anwendung gebracht werden darf, solange die gehaltenen Beteiligungen die in demselben geregelten Voraussetzungen der Beteiligung (5% oder Erwerbswert der Beteiligung über 20 Millionen Euro) und des Besitzes (ununterbrochenes Halten der Beteiligung am Tag der Übertragung) erfüllen.

[value] => De acuerdo con el artículo 10.3 de la LIS y valoración 9ª del Plan General de Contabilidad el resultado contable de la venta de los derechos preferentes de suscripción debe integrarse en la base imponible de la entidad transmitente de tales derechos.
La DGT en su consulta vinculante V3499-15, de 13 de noviembre de 2015, realizando una interpretación finalista del artículo 21 de la LIS, establece que aunque la renta derivada de la enajenación de derechos preferentes de suscripción no se corresponda con la percepción de dividendos distribuidos por una entidad participada ni con la transmisión de la participación tenida en esa, la exención prevista en dicho artículo 21 puede ser aplicada a esta renta siempre que las participaciones poseídas cumplan los requisitos de participación (5% o valor de adquisición de la participación superior a 20 millones de euros) y tenencia (posesión de la participación de manera ininterrumpida el día que se produzca la transmisión) previstos en el mismo.
