[value] => In einem gerichtlichen Verfahren außerhalb von Barcelona ist mit anderthalb Jahren Vorlauf der Termin für die mündliche Verhandlung angesetzt. Die Parteien müssen zu dem Termin alle Beweismittel beibringen, derer sie sich im Prozess bedienen wollen. Der Kläger sorgt dafür, dass zwei Zeugen und drei Sachverständige zu dem Termin erscheinen, was mit einem erheblichen Aufwand an Zeit und Geld verbunden ist.
Bevor die mündliche Verhandlung beginnt, stellt der Beklagte den Antrag, das Verfahren auszusetzen, da der Ausgang eines anderen Verfahrens, welches für dieses Verfahren von Bedeutung ist, abgewartet werden soll. Das Gericht befürwortet die Aussetzung und mit Zustimmung des Klägers wird der Gerichtstermin auf sechs Monate später vertagt.
Ein Richter, eine Gerichtssekretärin, eine Gerichtsgehilfin, zwei Rechtsanwälte, zwei Zeugen und drei Sachverständige haben in völlig unproduktiver Weise gearbeitet und ihre Arbeitskraft vergeudet. Das Ergebnis ist, dass nach zwei Jahren noch immer nicht einmal die mündliche Verhandlung stattgefunden hat.
Allein durch folgende kleine Änderung der Prozessordnung hätte sich dies vermeiden lassen:
„Der Antrag auf Aussetzung der mündlichen Verhandlung ist mindestens einen Monat vor dem Termin einzureichen und innerhalb von sieben Tagen vom Gericht zu bescheiden“.
An diesem Beispiel sieht man auch wie es möglich ist, dass in Spanien mehr Stunden im Jahr als in Deutschland gearbeitet wird und das Pro-Kopfeinkommen dennoch geringer ist. Gemäß einer OECD Statistik werden in Spanien 1.689 Stunden im Schnitt jährlich gearbeitet während es in Deutschland 1.371 Stunden sind. Gemäß einer IWF Statistik liegt das BIP pro Kopf in Spanien bei 29.150 $ während es in Deutschland bei 44.999 $ beträgt. Die fehlende Produktivität rührt in erster Linie von einer mangelhaften Organisation, für die der beschriebene Fall ein klares Beispiel ist.

El demandante organiza para la fecha del juicio la comparecencia de dos testigos y tres peritos, lo que supone una considerable inversión en tiempo y dinero.
Al inicio del juicio, el demandado solicita la suspensión del procedimiento, ya que desea esperarse al resultado de otro procedimiento, que considera importante y puede influir en éste. El tribunal se inclina por la suspensión y con el consentimiento del demandante, la fecha del juicio se aplaza hasta seis meses más tarde.
Un juez, un secretario judicial, un auxiliar del Juzgado, dos abogados, dos testigos y tres peritos han estado trabajando de forma totalmente improductiva y frustrante. El resultado es que tras dos años aún no se ha celebrado el juicio. Esto podría haberse evitado simplemente con la siguiente pequeña modificación de las normas procesales:
“La solicitud de la suspensión del juicio ha de ser presentada como mínimo con un mes de antelación a la fecha de la vista y deberá ser resuelta dentro de un plazo de siete días.”
Este ejemplo ilustra cómo es posible que en España, trabajándose más horas al año que en Alemania, la renta per cápita, sin embargo, sea más baja. Según una estadística de la OCDE, el promedio de horas trabajadas en España es de 1.689 horas, mientras que en Alemania es de 1.371 horas. Según una estadística del FMI, el PIB per cápita en España era de 29.150 $, mientras que Alemania de 44.999 $. La falta de productividad se debe principalmente a una mala organización de la cual el caso aquí descrito es un claro ejemplo.
