[value] => Gemäß eines Urteils der Zivilabteilung des Obersten Spanischen Gerichtshofs (Tribunal Supremo) vom 5.04.2016 kann eine spanische Tochtergesellschaft eines internationalen Konzerns bezüglich außervertraglicher Ansprüche gegen die ausländische Konzernmutter verklagt werden und haftbar sein.
In dem zugrundeliegenden Fall hatte der Kläger gegenüber Google Spain, der spanischen Tochtergesellschaft des Mutterkonzerns Google Inc., im Zusammenhang mit dem vom Europäischen Gerichtshof 2014 anerkannten „Recht auf Vergessen“ geltend gemacht, bestimmte persönliche Daten aus der Suchmaschine zu entfernen und Schadenersatz für die Verletzung von Persönlichkeitsrechten zu zahlen. Obwohl der Betrieb der Suchmaschine und die Verarbeitung der persönlichen Daten von der Konzernmutter Google Inc. aus den USA durchgeführt werden, und die Tätigkeit der Google Spain sich lediglich auf kommerzielle Aspekte wie den Verkauf von Werbeflächen auf der Webseite von Google beschränkt, führt der Tribunal Supremo aus, dass die Tätigkeiten der Konzernmutter und –tochter untrennbar miteinander verknüpft seien, da die Tätigkeit von Google Spain ohne den Betrieb der Suchmaschine durch Google Inc. nicht möglich wäre. Google Spain wird in dem Urteil zur Zahlung von Schadenersatz für die Verletzung von Persönlichkeitsrechten bei der Verarbeitung von Daten des Klägers durch die Muttergesellschaft Google Inc. verurteilt.
Anzumerken ist, dass die Verwaltungsrechtsabteilung des Tribunal Supremo in einem ähnlichen Fall im März entschied, dass Nutzer lediglich gegenüber der Konzernmutter Google Inc. Ansprüche aufgrund Rechtsverletzung durch Verarbeitung von persönlichen Daten geltend machen könnten. Diese Diskrepanz kann möglicherweise damit erklärt werden, dass es in dem verwaltungsrechtlichen Fall nicht um die Zahlung von zivilrechtlichem Schadenersatz, sondern um die Verantwortlichkeit für die Verarbeitung der Daten an sich ging.

[value] => Una sentencia de la sala de lo civil del Tribunal Supremo de fecha 5 de abril de 2016 ha establecido que la filial española de un grupo de sociedades internacional puede estar legitimada pasivamente ante el ejercicio de acciones extracontractuales contra la matriz y, por consiguiente, será responsable de las conductas realizadas por aquella.
La sentencia tiene por objeto una demanda presentada por un particular contra Google ejerciendo el “derecho al olvido”, que reconoció el Tribunal de Justicia de la Unión Europea en 2014. El demandante solicitó a Google Spain, la filial española de Google, el borrado de datos personales del buscador y el pago de una indemnización por daños sufridos por la vulneración de sus derechos. Aunque tanto el manejo del buscador, como el tratamiento de datos está realizado por la matriz Google Inc. y la actividad de la filial Google Spain se limita a asuntos comerciales como la promoción de ventas de espacios publicitarios en la página web de Google, el Tribunal Supremo considera que las actividades de la matriz y su filial están indisociablemente ligadas, porque la actividad de Google Spain no sería posible sin el manejo del buscador por Google Inc. La sentencia condena a la filial Google Spain al pago de una indemnización por daños causados en el tratamiento de los datos del demandante por la matriz.
Cabe señalar que la sala de lo contencioso-administrativo del Tribunal Supremo dictó en marzo una sentencia en un caso similar contra la filial Google Spain, acordando que los usuarios deberían dirigirse con su solicitud directamente a la matriz. Esta discrepancia quizas se puede explicar por tratarse de dos jurisdicciones diferentes y porque el objeto de la demanda, en este caso, no era por los daños sufridos, sino por el tratamiento de los datos que sólo incumbe a la matriz.
