[value] => In Spanien kann der Arbeitgeber im Rahmen seiner beruflichen Tätigkeit auf ein Verfahren zur wesentlichen Änderung der Arbeitsbedingungen beschlieβen. Er muss jedoch die zugrundeliegenden wirtschaftlichen, technischen, organisatorischen oder produktionsbezogenen Umstände darlegen.
Was sind wesentliche Änderungen der Arbeitsbedingungen?
Jede Änderung der folgenden Arbeitsbedingungen, die das Arbeitsverhältnis nachhaltig beeinträchtigen:
- Arbeitszeit
- Planung und Aufteilung der Arbeitszeiten
- Schichtsystem
- Gehalt
- Arbeitssystem
- Aufgabenzuweisung.
Wann werden Änderungen als allgemeingültig angesehen?
Wenn sie innerhalb eines Zeitraumes von 90 Tagen mindestens die folgenden im spanischen Gesetz enthaltenen Vorgaben betreffen:
- 10 Arbeitnehmer in Unternehmen mit weniger als 100 Arbeitnehmern
- 10% der Arbeitnehmer in Unternehmen mit 100-300 Arbeitnehmern
- 30 Arbeitnehmer in Unternehmen mit mehr als 300 Arbeitnehmern.
Verfahren zur wesentlichen Änderung der Arbeitsbedingungen
Dem Beschluss einer allgemeingültigen ganzheitlichen Änderung muss eine Reihe von Verhandlungen mit den Vertretern der Arbeitnehmer vorausgehen. Nach Artikel 41 des „Estatuto de los Trabajadores“ (Arbeiterstatuten) muss sich das Unternehmen an die folgenden Schritte halten:
a) Die Unternehmensleitung muss die Arbeitnehmer oder ihre rechtlichen Vertreter umfassend über ihre Absicht informieren. Eine Verhandlungskommission muss eingerichtet werden.
Die Frist für die Bildung der Verhandlungskommission beträgt 7 Tage, bzw. 15 Tage, wenn das Unternehmen keine Arbeitnehmervertreter hat.
b) Die Konsultationsphase darf 15 Tage nicht überschreiten.
c) Der Konsultationszeitraum kann mit oder ohne Vereinbarung abgeschlossen werden. Der Beschluss ist sowohl den einzelnen Arbeitnehmern als auch ihren Vertretern mitzuteilen. Der Beschluss wird 7 Tage nach dieser Mitteilung wirksam.
d) Der Beschluss kann in einem Sammelklageverfahren angefochten werden.
Es ist zwingend erforderlich, dass der Arbeitgeber das gesetzlich vorgeschriebene Verfahren einhält und die Gründe angibt, die die Entscheidung über eine wesentliche allgemeingültige Änderung rechtfertigen. Die Nichteinhaltung einer der beschriebenen Anforderungen kann zur Nichtigkeit des Verfahrens führen.

Qué se considera modificación sustancial de las condiciones de trabajo
Aquellas modificaciones que afecten, de manera notoria, a alguna de estas materias:
- Jornada de trabajo
- Horario y distribución de la jornada de trabajo
- Trabajo a turnos
- Remuneración
- Sistema de trabajo
- Funciones atribuidas al trabajador.
Cuándo tienen las modificaciones el carácter colectivo
Cuando, en un periodo de 90 días, afecten al menos a los límites establecidos en la Ley:
- 10 trabajadores en empresas de menos de 100 trabajadores
- Al 10% de trabajadores en empresas de entre 100-300 trabajadores
- 30 trabajadores en empresas que tengan más de 300 trabajadoresa
Procedimiento de modificación sustancial de las condiciones de trabajo
La decisión de modificación sustancial colectiva debe ir precedida de un periodo de consultas con los representantes de los trabajadores de la empresa. Atendiendo a lo establecido en el artículo 41 del Estatuto de los Trabajadores, se deben seguir los siguientes pasos:
a) La dirección de la empresa debe comunicar fehacientemente a los trabajadores o a sus representantes legales la intención de iniciar un proceso de modificación sustancial de carácter colectivo.
Se abre entonces un plazo de 7 días (15 si no hubiera representantes de trabajadores) para constituir la comisión negociadora que participará durante el periodo de consultas.
b) Constituida la comisión, la empresa comunicará fehacientemente el inicio del periodo de consultas (no superior a 15 días)
c) El periodo de consultas podrá cerrarse con o sin acuerdo. La decisión se notificará tanto a los trabajadores individualmente como a sus representantes y surtirá efectos en el plazo de 7 días desde su notificación
d) La decisión podrá impugnarse en conflicto colectivo, sin perjuicio de las acciones individuales que contempla la Ley.
El incumplimiento de alguno de los requisitos establecidos o la mala fe durante las negociaciones, determinará la nulidad del procedimiento, por lo que las empresas deberán cumplir escrupulosamente con lo estipulado en el Estatuto de los Trabajadores.
