[value] => Seit dem 12. Mai 2019 sind Unternehmen in Spanien dazu verpflichtet, die täglichen Arbeitszeiten ihrer Mitarbeiter zu protokollieren. Die Nichteinhaltung dieser Maßnahme wird mit einer Sanktion von bis zu 6.250 € geahndet.
1. Pflicht die Arbeitnehmervertreter zu informieren
Vor der Einführung eines Systems für die Arbeitszeiterfassung sollte sich das Unternehmen mit den Vertretern der Arbeitnehmer abstimmen. Für den Fall dass es keine Arbeitnehmervertretung gibt, kann das Unternehmen allein über das einzuführende System entscheiden.
2. Was gilt, wenn bereits ein System für die Erfassung der Arbeitszeiten besteht?
Das System muss mit den Arbeitnehmervertretern, sofern diese vorhanden sind, verhandelt und genehmigt werden.
3. Führungskräfte
Führungskräfte sind nicht dazu verpflichtet ihre Arbeitszeiten zu erfassen.
4. Die Arbeitszeiterfassung kann die Aufdeckung von Verstößen zur Folge haben
Die Erfassung der Arbeitszeiten kann Verstöße von Seiten des Unternehmens sowie von Seiten der Arbeitnehmer aufdecken. Das Unternehmen hat im letztgenannten Fall das Recht entsprechende disziplinarische Maßnahmen zu ergreifen.
5. Formen der Arbeitszeiterfassung
Die Arbeitszeit kann in schriftlicher oder in elektronischer Form erfasst werden.
6. Urlaub, Pausenzeiten, Bereitschaftsdienstzeit und Mittagspausen
Das Arbeitszeiterfassungssystem soll die tatsächlichen Arbeitsstunden erfassen.Die jährlichen Urlaubstage, die Pausenzeiten, die Bereitschaftsdienstzeit oder die Mittagspausen gehören nicht dazu.
7. „Flexible“ Mitarbeiter
Die Arbeitszeiterfassungspflicht der Unternehmen gilt auch für sogenannte „flexible“ Mitarbeiter.
8.Home-Office
Die Unternehmen sind gleichermaßen dazu verpflichtet die Arbeitszeiten zu erfassen.
9. Digitale Abschaltzeit
Das Unternehmen ist verpflichtet eine interne Richtlinie bezüglich des Rechts auf digitale Abschaltzeit außerhalb der regulären Arbeitszeiten zu erlassen.
10. Aufbewahrung der Aufzeichnungen
Die Aufzeichnungen der Arbeitszeiten müssen mindestens 4 Jahre lang aufbewahrt werden.
11. Leiharbeiter in dem Unternehmen
Im Falle von Leiharbeitern, trägt das Unternehmen die Verantwortung der korrekten Arbeitszeiterfassung.
12. Die Arbeitszeiterfassung als Beweis für Überstunden
Das Unternehmen muss zwei - voneinander unabhängige - Vorgaben bei der Protokollierung beachten: die Erfassung der Arbeitszeiten und die Erfassung etwaiger Überstunden.
13. Datenschutz
Das Unternehmen sollte die Aufzeichnungen der Arbeitszeiterfassung wie persönliche geschützte Daten behandeln, bei denen die Arbeitnehmer über die damit einhergehenden disziplinarischen Maßnahmen zu informieren sind.
14. Zugang zu den Aufzeichnungen
Die Aufsichtsbehörde für Arbeit und Sozialversicherung hat Zugang zu den Aufzeichnungen der Arbeitszeiterfassung; die rechtlichen Vertreter des Unternehmens haben beschränkten Zugang bei ihren jeweiligen Arbeitsstellen; die Arbeitnehmer haben nur zu ihren eigenen Aufzeichnungen Zugang.
15. Mitteilung der Auswertungen
Das Unternehmen ist nicht dazu verpflichtet die Auswertungen der Arbeitszeiterfassung mitzuteilen.

[value] => Desde el 12 de mayo de 2019 las empresas en España están obligadas a llevar un registro diario de la jornada de trabajo de sus trabajadores. El incumplimiento de esta medida conlleva multas que pueden alcanzar los 6.250 €.
1. Obligación de informar a los representantes legales de los trabajadores
Antes de establecer cualquier sistema de registro de jornada de trabajo, la empresa debe consensuarlo con los representantes legales de los trabajadores. Si no los hubiera, la empresa podrá decidir qué sistema implementar.
2. ¿Y si ya existe un sistema de registro de jornada?
El sistema deberá ser negociado y aprobado por los representantes legales de los trabajadores, si los hubiere.
3. Trabajadores de alta dirección
Los trabajadores de alta dirección no están obligados a registrar su jornada.
4. El sistema de registro de jornada puede revelar otros incumplimientos
El sistema de registro de la jornada de trabajo puede revelar otros incumplimientos, ya sea por parte de la empresa, como por parte del trabajador (en cuyo caso la empresa tendrá derecho a ejercitar las acciones disciplinarias correspondientes).
5. Formatos del registro de jornada
Podrá ser en formato papel o en formato electrónico.
6. Tiempo de descanso, horas de guardia y pausas para el almuerzo
A efectos del registro de jornada sólo computan las horas efectivas de trabajo. Las vacaciones anuales, el tiempo de descanso, las horas de guardia o la hora del almuerzo no se consideran horas efectivas de trabajo.
7. Trabajadores flexibles
Las empresas están obligadas a cumplir con el registro de jornada, también respecto de los trabajadores flexibles.
8. Teletrabajo
Las empresas están obligadas a cumplir con el registro de jornada de los teletrabajadores.
9. Desconexión digital
La empresa está obligada a establecer una política interna sobre el derecho de desconexión digital fuera del horario laboral.
10. Conservación de los registros
Los registros de jornada de trabajo deben ser conservados durante cuatro años.
11. Trabajadores subcontratados en la empresa
En el caso de trabajadores subcontratados, la responsabilidad recae sobre la empresa subcontratada.
12. El registro de jornada como prueba de horas extraordinarias
La empresa debe cumplir con dos obligaciones independientes de registro: de registro de jornada y de registro de horas extraordinarias.
13. Protección de datos
La empresa deberá tratar el registro de jornada como datos personales protegidos, informando explícitamente a los trabajadores de las medidas disciplinarias que pueden derivarse.
14. Acceso al registro
La Inspección de Trabajo y Seguridad Social tendrá acceso al registro de jornada de trabajo. Los representantes legales también, pero limitado al lugar de trabajo que representan. Los trabajadores sólo a sus propios registros.
15. Comunicación de los resultados
La empresa no está obligada a comunicar los resultados del registro de jornada.
