[value] => Wir starten in ein neues Jahr und ein neues Jahrzehnt, das einige Veränderungen mit sich bringt, unter anderem die Verjährung der zwischen 2005 und 2015 generierten Schulden. Jeder Gläubiger muss in diesem Jahr mit Vorsicht agieren, damit die Fristen der Schulden nicht verjähren, die er noch eintreiben muss. Als Folge der Reform, die durch das Gesetz 42/2015 vom 5. Oktober (in Kraft seit 7. Oktober 2015), in unser spanisches Bürgerliches Gesetzbuch eingeführt wurde, wurde die Verjährungsfrist für persönliche Schulden, von 15 auf nur 5 Jahre verkürzt. Um zu vermeiden, dass diese Verkürzung der Frist denjenigen Personen, die ein Verfahren anhängig gemacht haben, auf das diese Verjährungsfrist anwendbar ist, Schaden zufügt und sie die Möglichkeit verlieren, einen Anspruch geltend zu machen, wurde eine Übergangsregelung eingeführt. Das bedeutet, dass alle persönlichen Handlungen, die ihren Ursprung vor dem 7. Oktober 2015 haben, spätestens an diesem schicksalhaften Tag, dem 7. Oktober 2020, verjährt sind.
WAS IST IM JAHR 2020 ZU TUN?
Das wird davon abhängen, ob wir über den Gläubiger oder den Schuldner sprechen. Was den Schuldner betrifft, so wird er nichts tun müssen, und vielleicht wird 2020 sein Glücksjahr sein, in dem er die Befreiung von seinen Schulden feiern kann. Der Gläubiger einer Schuld muss jedoch die Verjährung durch Zahlungsbefehle an den Schuldner mitteilen und unterbrechen. Eine solche Unterbrechung der Verjährung kann durch eine außergerichtliche Zahlungsaufforderung oder durch jede andere Maßnahme erfolgen. Dies würde den oben genannten Zeitraum unterbrechen und die fünfjährige Frist würde erneut beginnen, wie es das spanische Bürgerliche Gesetzbuch zu diesem Zeitpunkt vorsieht. Es würde ausreichen, ein sogenanntes „Burofax“ oder ein Einschreiben zu schicken, mit dem klaren Inhalt, dass die ausstehende Schuld eingefordert wird. Daher ist es von entscheidender Bedeutung, so schnell wie möglich alle unbezahlten und vertragswidrigen Forderungen zu überprüfen, denn wenn die entsprechenden Forderungen nicht geltend gemacht werden, ist es möglich, dass die Forderung verjährt und Sie von der massiven Verjährung der Forderungen, die am 7. Oktober 2020 stattfinden wird, betroffen sind.

[value] => Empezamos un nuevo año y una nueva década que trae varios cambios a tener en cuenta, entre ellos, las prescripciones de las deudas generadas entre 2005 y 2015. Cualquier acreedor deberá en este año ser diligente para evitar que le prescriban los plazos de las deudas que deba cobrar. Como consecuencia de la reforma que la Ley 42/2015, de 5 de octubre- en vigor desde el 7-, introdujo en nuestro Código Civil, el plazo de prescripción de las acciones personales, se redujo de 15 a solo 5 años. Para evitar que esa reducción del plazo causara perjuicios a aquellas personas que tenían pendiente de ejercitar una acción a la que fuera aplicable ese plazo de prescripción y que éstas perdieran la posibilidad de reclamar, se introdujo un régimen transitorio. Esto significa que todas aquellas acciones personales nacidas con anterioridad al día 7 de octubre de 2015 prescribirán, como muy tarde, ese fatídico día: el 7 de octubre de 2020.
¿QUÉ HACER EN 2020?
Pues dependerá de si hablamos del acreedor o del deudor. En cuanto al deudor, éste no deberá hacer nada y puede que el 2020 sea su año de suerte pudiendo celebrar haberse librado de su deuda. Sin embargo, el acreedor de una deuda deberá notificar e interrumpir la prescripción mediante requerimientos de pago al deudor. Dicha interrupción de la prescripción se puede llevar a cabo mediante la reclamación extrajudicial de cobro o con cualquier actuación. Con ello, se interrumpiría el plazo antes citado y volvería a computar desde el inicio en cinco años que es lo que marca el Código Civil en estos momentos. Bastaría con mandar un Burofax o una carta certificada, con el contenido claro que se reclama dicha deuda pendiente. Por tanto, resulta de vital importancia revisar, lo antes posible, todos aquellos impagados e incumplimientos contractuales sufridos y que estén pendientes de reclamar, pues en caso de no iniciar las gestiones de reclamación, es posible que, cuando se pretenda hacerlo, la acción haya prescrito, y te veas afectado por la prescripción masiva de acciones que tendrá lugar el día 7 de octubre de 2020.
