[value] => Wenn im Prozess Tatsachen streitig sind, die von einem Richter nicht aus eigener Sachkunde beurteilt werden können, kommt eine Beweisführung durch ein Sachverständigengutachten in Betracht. Häufig ist es zweckmäßig, ein Privatgutachten über eine Schadensursache oder einen mangelhaften Zustand einer Ware im Vorfeld eines Rechtsstreits einzuholen, nicht zuletzt um die eigenen Prozessaussichten besser einschätzen zu können. Ein Privatgutachten wird aber häufig von dem Gegner im Prozess nicht anerkannt und der Richter muss noch einen offiziellen Gutachter zur Beurteilung des Sachverhalts bestimmen. Es kommt dann immer wieder vor, dass sich die verschiedenen Gutachten inhaltlich widersprechen. Der Bundesgerichtshof hat im November 2019 (VIII ZR 344/18) in einer wichtigen Entscheidung festgestellt, dass Richter sich mit etwaigen Widersprüchen zwischen einem Privatgutachten und dem Gutachten des gerichtlich bestellten Sachverständigen eingehend auseinanderzusetzen haben.
In dem zugrundliegenden Fall waren die Richter dem Privatgutachten gefolgt und hatten die Widersprüche, die sich zu dem gerichtlich erstatteten Gutachten ergaben, nicht aufgeklärt. Der BGH stellt klar, dass ein Richter in einem solchen Fall die beiden Gutachter gegebenenfalls in einer Gegenüberstellung persönlich anhören muss, um solchen Widersprüchen auf den Grund zu gehen. Hilft auch dies nicht zur Aufklärung, muss gegebenenfalls ein weiterer Sachverständiger bestellt werden. Interessanterweise hat der BGH die konkrete Situation nicht nur als fehlerhafte Beweiswürdigung bewertet (dann wäre diese Frage in der Revisionsinstanz nur eingeschränkt überprüfbar gewesen), sondern als Verletzung des Grundrechts auf rechtliches Gehör. Ein Richter muss sich mit sämtlichen Tatsachen und Argumenten auseinandersetzen, die die Parteien vortragen und dazu gehören eben auch die Feststellungen eines Sachverständigen.

[value] => Cuando en un proceso judicial existen hechos controvertidos que no pueden ser evaluados por el conocimiento profesional de un juez, se podrá considerar la posibilidad de presentar un dictamen pericial como medio de prueba. A menudo, resulta oportuno solicitar un dictamen privado sobre la causa del daño o el estado defectuoso de un producto antes del litigio para poder evaluar mejor las propias perspectivas del proceso. Sin embargo, con frecuencia, el dictamen pericial no es reconocido por la parte contraria y el juez debe designar un perito oficial para el enjuiciamiento de los hechos. Suele ocurrir entonces que los diferentes dictámenes periciales se contradigan entre sí en cuanto a su contenido. En noviembre de 2019, el Tribunal Federal de Justicia alemán [Bundesgerichtshof, de forma abreviada, BGH] estableció en una importante resolución (VIII ZR 344/18) que los jueces tienen que examinar detalladamente las posibles contradicciones entre el dictamen privado y el dictado emitido por el perito que ha sido designado judicialmente.
En el caso al que nos remitimos, los jueces se habían guiado por el dictamen privado sin aclarar las contracciones surgidas frente al dictamen pericial judicial. El Tribunal Federal de Justicia alemán [BGH] deja claro que, en tal supuesto, se debe escuchar personalmente a ambos peritos en un careo, llegado el caso, para identificar el motivo de dichas contradicciones. Si esto tampoco ayuda a aclarar la situación, deberá ser designado otro perito, si procede. Resulta interesante señalar el hecho de que el juez no sólo valoró la concreta situación como una defectuosa valoración de la prueba (en cuyo caso esta cuestión sólo habría sido objeto de una revisión limitada en la instancia de casación) sino como una infracción del derecho constitucional a ser oído. Un juez tiene que razonar todos los hechos y argumentos expuestos por las partes y esto también incluye las conclusiones a las que llegue un perito.
