[value] => Das Landgericht Ávila (Audiencia Provincial de Ávila) bestätigt die Freiheitsstrafe eines Ehepaares und seiner Kinder für ihre Schenkungen untereinander, um die Zahlung der Entschädigungen durch die Mutter zu verhindern, zu deren Leistung sie verurteilt worden war.
Der Sachverhalt betrifft die Ereignisse vom 11. März 2011 als in der Wohnung der Mutter ein Feuer ausbrach. Aufgrund dieses Brandes wurde die Eigentümerin der verbrannten Wohnung, die Mutter, dazu verurteilt, den betroffenen Nachbarn einen Entschädigungsbetrag in Höhe von insgesamt 166.510,88 € zu zahlen. Da die Mutter diesen Betrag nicht zahlte, beabsichtigten die Betroffenen ihre Vermögenswerte gerichtlich pfänden zu lassen. Als sie jedoch die Pfändung beantragten, stellten sie fest, dass nun keine Vermögenswerte mehr auf den Namen der Mutter eingetragen waren.
Angesichts dieser Umstände leiteten die Nachbarn ein Strafverfahren gegen die Mutter, ihren Ehemann und die Kinder ein, da sie davon ausgingen, dass die Familie gemeinsam einen Plan geschmiedet hatte, um die Entschädigungszahlungen zu verhindern, zu deren Leistung die Mutter als Urheberin des Brands verurteilt worden war. Kaum einen Monat nach dem Brand schenkten die Eltern in öffentlicher Urkunde ihren Kindern diverse Immobilien, sodass die Mutter über keine Vermögenswerte mehr verfügte, als die Nachbarn versuchten diese zu pfänden.
Angesichts dieser Ereignisse hat das Landgericht alle Familienmitglieder zu zweieinhalb Jahren Freiheitsstrafe für ein Insolvenzdelikt verurteilt. So lautet der Urteilstenor: Um die Gläubiger (Nachbarn) zu schädigen, begingen die vier Familienmitglieder betrügerische Handlungen, indem sie die Schenkungen der Immobilien nur zu dem Zweck vornahmen, um die Zahlung der Entschädigung zu verhindern, zu deren Leistung, die Mutter verurteilt worden war. Ferner erklärt das Urteil die Schenkungen nichtig, die nach dem Brand erfolgten.

[value] => La Audiencia Provincial de Ávila confirma la condena a un matrimonio y a sus hijos por las donaciones que se hicieron entre ellos para evitar que la madre abonara la indemnización a la que había sido condenada.
Los hechos se remiten al 11 de marzo de 2011 cuando tuvo lugar un incendio en la vivienda de la madre. Como consecuencia de este incendio, la propietaria de la vivienda incendiada, la madre, fue condenada mediante sentencia y como consecuencia del fuego que se originó en su vivienda a pagar a los vecinos afectados el importe total de 166.510,88.-€. Ante la falta de pago de la madre, los afectados intentaron judicialmente embargar los bienes de la condenada, si bien, cuando fueron a hacerlo comprobaron que ya no tenía bienes a su nombre.
En consecuencia, ante estos hechos, los vecinos iniciaron un procedimiento penal contra la madre, su esposo y los hijos de ambos al entender que todos ellos de manera conjunta habían ideado un plan para eludir que la madre tuviera que pagar la indemnización a la que había sido condenada como autora del incendio. En concreto, porque apenas un mes después del incendio, los padres, mediante escritura pública, habían donado a sus hijos diversos bienes inmuebles de modo que cuando los vecinos fueron a embargo de los bienes de la madre comprobaron que ya no tenía.
Por lo que antecede, la Audiencia ha condenado a todos ellos a dos años y medio de cárcel por un delito de insolvencia punible. La sentencia determina que, con el fin de perjudicar a los acreedores (vecinos), los cuatro miembros de la familia realizaron actos fraudulentos mediante la donación de los inmuebles con el único fin de evitar que la madre tuviera que cumplir con el pago de la indemnización a la que había sido condenada. Sentencia que además declara la nulidad de las donaciones practicadas con posterioridad al incendio.
