[value] => Der Schutz der Modekreationen ist und bleibt ein ungelöstes Problem in der Modebranche. Viele der geführten Prozessverfahren drehen sich um Verletzungen von Industriedesign, da die Kreationen von Designern immer häufiger kopiert werden. Diese „Kopien“ werden in der Modewelt als „knockoffs“ bezeichnet. Es besteht nach wie vor eine Diskrepanz, ob es sich bei den Nachahmungen um echte Kopien von Originalen handelt oder ob sie lediglich eine Inspiration darstellen. Aktuell hat die Haute-Couture-Firma Versace den Online-Shop Fashion Nova wegen des Verkaufs einer Kopie des ikonischen grünen “Dschungelkleides”, welches Jennifer Lopez bei den 2000 Grammys und erneut bei der Mailänder Modewoche 2019 trug, verklagt. Versace behauptet, dass die Low-Cost-Plattform ihre Popularität und ihr Prestige ausnutzt, indem sie sich von ihren Kreationen inspirieren lässt, um dadurch auf ihre Kosten wirtschaftlich zu profitieren. In der Welt der “Fast Fashion” ist es normal geworden, die Kreationen anderer zu kopieren. Zara ist in viele Plagiatsprobleme verwickelt. Im August 2019 zirkulierte in sozialen Netzwerken der Satz “ eigentlich solltest du aufhören Zarita“, nachdem sie einige Entwürfe der kubanischen Modemarke „Clandestina” kopiert hatte.
Im spanischen Recht werden Modeschöpfungen durch eingetragenes und nicht eingetragenes gewerbliches Geschmacksmusterrecht, Urheberrecht und unlauteren Wettbewerbsrecht geschützt.
Der Eintragungsschutz eines gewerblichen Musters gewährt seinem Inhaber für 5 Jahre (verlängerbar auf maximal 25 Jahre) das ausschließliche Recht, es zu benutzen und die Verwendung durch Dritte zu verhindern. Der Schutz von eingetragenen gewerblichen Geschmacksmustern wird durch das Gesetz 20/2003 vom 7. Juli geregelt. Das nicht eingetragene Geschmacksmuster ist durch die Europäische Verordnung Nr. 6/2002 vom Dezember 2001 mit Wirkung für die gesamte Europäische Union geschützt.

Muchos de los litigios tratan en la actualidad sobre infracciones del diseño industrial por el aumento de “knockoffs” de las creaciones de los diseñadores. En la industria de la moda existe todavía discrepancia sobre si los knockoffs son auténticas copias de los diseños originales o si se trata simplemente de inspiraciones.
En la actualidad, la firma de alta costura Versace ha demandado al shop online Fashion Nova por poner a la venta una copia del icónico vestido verde “Jungle Dress” que Jennifer Lopez llevó por primera vez en los Grammys del año 2000, y nuevamente en la pasarela de la semana de la moda de Milán en 2019. En su demanda, Versace alega que la plataforma “low cost” se está aprovechando de su popularidad y prestigio inspirándose en sus creaciones con el fin de lucrarse económicamente a su costa. En el mundo de la Fast Fashion ha llegado a ser normal copiar las creaciones de los demás. Es el caso, por ejemplo, de Zara, que está involucrada en diversos litigios por plagio. En agosto 2019 circuló en redes sociales la frase “actually, Zarita tienes que parar” tras haber copiado algunos de los diseños de la maca cubana “la Clandestina”.
En el derecho español, las creaciones de moda están protegidas a través del diseño industrial registrado y no registrado, el derecho de autor y la competencia desleal. La protección registral de un diseño industrial le otorga a su titular durante 5 años (prorrogable hasta un máximo de 25 años), el derecho exclusivo a utilizarlo e impedir su utilización por terceros. La protección del diseño industrial registrado está regulada en la Ley 20/2003, de 7 de julio. El diseño no registrado está protegido con efecto en toda la Unión Europea a través del Reglamento Europeo 6/2002 de diciembre de 2001. La protección del diseño no registrado se concede cuando éste es novedoso y de carácter singular. El plazo de protección del diseño no registrado es de 3 años a partir de que el dibujo se hace público por primera vez dentro de la Unión Europea. Conforme a las normas del Reglamento Europeo, el diseño no registrado le otorga a su titular el derecho a impedir los actos de utilización del producto si la utilización impugnada resulta de haber sido copiado el dibujo o modelo protegido. Además, conforme al Reglamento, no se considerará como copia un diseño resultante de un trabajo de creación independiente realizado por el autor del que se pueda pensar razonablemente que no conocía el dibujo o modelo divulgado por el titular. Sin embargo, no es necesaria que la copia sea idéntica, bastará un diseño que no produzca en el usuario informado una impresión general distinta.
