[value] => Ende des vergangenen Jahres verabschiedete die Regierung das Königliche Gesetzesdekret 21/2018 vom 14. Dezember über dringende Maßnahmen im Bereich des Wohn- und Mietrechts, welches wichtige Änderungen im Mietrecht einführte.
So wurde beispielsweise die für den Vermieter zwingende Mindestvertragsdauer von 3 auf 5 Jahre erhöht (womit die Regelung, die vor 2013 in Kraft war, wiederhergestellt wurde), bzw. auf 7, wenn der Vermieter eine juristische Person ist. Die automatische Verlängerung erhöhte sich von einem Jahr auf 3 Jahre (was ebenfalls der vor 2013 gültigen Regelung entspricht). Des Weiteren wurden die Garantien, die der Vermieter zusätzlich zur Kaution fordern kann, auf einen Betrag von höchstens 2 Monatsmieten beschränkt.
Obwohl die erwähnte Reform erst im Dezember 2018 in Kraft getreten ist, ist sie heute schon nicht mehr gültig, weil das Parlament aufgrund politischer Schwankungen das Königliche Gesetzesdekret nicht ratifiziert hat, so dass nun wieder die vor dem 19. Dezember 2018 gültige Regelung gilt.
Aber was geschieht nun mit den Verträgen, die in dem Zeitraum unterschrieben worden sind, in dem das Königliche Gesetzesdekret vom vergangenen Dezember galt, d.h. in der Zeit vom 19. Dezember 2018 bis zum 22. Januar 2019? Diese Mietverträge richten sich nach der im Königlichen Gesetzesdekret enthaltenen Regelung, d.h., Mietverträge, die in dem erwähnten Zeitraum unterschrieben wurden, unterliegen einer Sonderregelung. Hierauf muss in Zukunft, insbesondere bei Streitigkeiten, geachtet werden.
Vermieter könnten jetzt versuchen, diese Mietverträge abzuändern, um sie der vormaligen, jetzt wieder gültigen Regelung anzupassen. Mieter müssen wissen, dass dies nur möglich ist, wenn sie mit der Abänderung völlig einverstanden sind.

[value] => El pasado mes de diciembre, el gobierno aprobó el Real Decreto-ley 21/2018, de 14 de diciembre, de medidas urgentes en materia de vivienda y alquiler, que introducía importantes novedades en la regulación de los arrendamientos urbanos.
Así, por ejemplo, los años de duración del contrato obligatorios para el arrendador pasaron a ser de tres a cinco años (como en la regulación anterior a la reforma del año 2013), excepto si el arrendador era una persona jurídica, que entonces serían siete años. La prórroga automática pasaba de ser de un año a tres (como también estaba contemplada antes de la reforma del 2013) y también se limitaban a un máximo de dos mensualidades las garantías adicionales a la fianza que podía exigir el arrendador al arrendatario.
A pesar de ser una reforma del pasado mes de diciembre, hacemos referencia a ella en términos pasados, ya que los vaivenes de la política actual han querido que el Real Decreto-ley no haya sido convalidado por el congreso, hace apenas unos días, lo que irremediablemente supone que la regulación anterior al 19 de diciembre de 2018 es la que sigue plenamente vigente.
Ahora bien, ¿qué sucede con los contratos suscritos bajo la vigencia del Real Decreto-ley de diciembre, es decir, aquellos firmados entre el 19 de diciembre de 2018 (día posterior al de su publicación en el BOE) y el 22 de enero de 2019 (fecha de su derogación por el Congreso)? Pues dichos contratos se regirán por la normativa establecida en el citado Real Decreto-ley. Habrá, por lo tanto, unos pocos contratos, firmados a lo largo de apenas un mes, con un régimen un tanto sui generis, pero perfectamente válidos. Será conveniente recordarlo en caso de que se produzcan disputas en relación con dichos contratos.
Quizás algunos arrendadores traten de modificar el contrato suscrito en esas semanas para adaptarlo a la normativa ahora vigente, pero debe saber el arrendatario que sólo podrá hacerse si él está plenamente de acuerdo con dicha modificación.
