[value] => Berufliche Reisen in das Ausland stehen heute auf der Tagesordnung. Viele sind sich jedoch der Verpflichtung nicht bewusst, dass sie eine A1 Bescheinigung auch für kurze Auslandsaufenthalte wie z.B. die Teilnahme an einem Kongress oder einem Geschäftsmeeting bei sich zu führen haben.
Auch wenn es sich dabei nicht um eine neue Regelung handelt, wurden bisher häufig die Beantragung und die anschließende Überprüfung der Bescheinigung außer Acht gelassen.In Deutschland sind Arbeitgeber seit dem 1.Januar 2019 verpflichtet, die A1 Bescheinigung für ihre Arbeitnehmer, die im Rahmen ihrer Dienstleistungen vorübergehend in ein anderes EU Land oder nach Island, Norwegen, Liechtenstein bzw. in die Schweiz entsandt werden, elektronisch zu beantragen. Auch Selbständige sind nicht von der Beantragung einer A1 Bescheinigung anlässlich ihrer Geschäftsreisen befreit. Aber vorerst kann der Antrag für Selbstständige nur in Papierform gestellt werden.
Bei einer vorübergehenden Entsendung in eines der genannten Länder müssen deutsche Arbeitnehmer und Selbständige die A1 Bescheinigung bei sich führen; sie bescheinigt, dass ihr Inhaber für die Dauer seines Aufenthalts weiterhin dem deutschen Sozialversicherungsrecht unterliegt und daher in dem Land, in das er entsandt wurde, von Sozialversicherungsbeiträgen befreit ist.
Um die Einhaltung dieser Verpflichtung zu gewährleisten, haben einige Länder wie z.B Frankreich, bereits damit begonnen, ihre Kontrollen zu verstärken und die A1 Bescheinigung sogar bei LKW Fahrern, die auf ihren Straßen unterwegs sind, zu verlangen. Die Nichtbeachtung dieser Verpflichtung zur Mitnahme der A1 Bescheinigung kann zur Verhängung von Geldbußen führen.

A pesar de ello, muchos desconocen la obligatoriedad de llevar consigo el Formulario A1 incluso en aquellas estancias de corta duración como puede ser la asistencia a un Congreso o a una reunión de negocios. Y es que aunque no se no se trata de una nueva obligación, hasta hace poco la tramitación de su solicitud, y su posterior control, se ha pasado, con frecuencia, por alto.
En Alemania, a partir del 1 de enero de 2019 se ha impuesto a los empresarios la obligación de solicitar electrónicamente para sus trabajadores dicho Formulario A1, siempre que estos sean desplazados temporalmente a otros Estados de la Unión Europea así como a Islandia, Liechtenstein, Noruega y Suiza, en el marco de su prestación de servicios. Los autónomos tampoco se libran de solicitar el Formulario A1 con motivo de sus viajes de negocios al extranjero, aunque, por el momento, únicamente deberán tramitar dicha solicitud en papel.
En sus desplazamientos temporales por los referidos países, los empleados y autónomos alemanes deberán ir provistos del Formulario A1, que certificará que su titular continúa sometido a la legislación alemana en materia de Seguridad Social durante el período que dure su desplazamiento, y por tanto, estará exento de cotizar a la Seguridad Social en el país en el que se encuentre desplazado.
Para garantizar el cumplimiento de esta obligación, algunos de los países afectados como, por ejemplo, Francia, han empezado ya a intensificar sus controles y a solicitar el Formulario A1 incluso a los transportistas que viajan por sus carreteras. El no llevar consigo el Formulario A1 podrá dar lugar a la imposición de sanciones económicas.
