[value] => Das Jahr 2019 beginnt mit Neuheiten im Arbeitsrecht. Der branchen-übergreifende Mindestlohn wurde um 22,3% erhöht, die grösste Erhöhung in den letzten vier Jahrzehnten, und beläuft sich nunmehr auf 900.-€ monatlich, 191,40 € mehr als im Vorjahr.
Dies wirkt sich u.a. auf den Praktikumsvertrag aus, dessen Ziel es ist, jungen Universitätsabsolventen die Erlangung einer ihrem Bildungsniveau angemessenen Berufspraxis zu ermöglichen. Dieser Vertragstyp ist für Unternehmen interessant, da sich die gesetzlich vorgesehene Vergütung im ersten Jahr der Vertragsdauer auf mindestens 60% und im zweiten Jahr auf mindestens 75% des im anwendbaren Tarifvertrag (TV) festgesetzen Mindestlohns beläuft. Jedoch darf die sich unter Anwendung der genannten Prozentsätze ergebende Vergütung in keinem Fall geringer sein als der zuvor genannte brachenübergreifende Mindestlohn. Unternehmen müssen daher bei Abschluss eines Praktikumsvertrages diesen neuen Betrag des Mindestlohns bei Berechnung des Gehaltes anhand der Gehaltsvorgaben des TV berücksichtigen. Eine weitere Neuheit ist die Abschaffung, mit Wirkung seit dem 1. Januar 2019, der Bonifikationen der Praktikumsverträge, die an die Arbeitslosenquote in Spanien geknüpft waren, da sich diese gegenwärtig auf weniger als 15% reduziert hat. Insoweit bleibt jedoch abzuwarten, was passiert, falls sich die Arbeitslosenquote erneut erhöhen sollte.
Die weiteren Voraussetzungen zum Abschluss eines Praktikumsvertrages gelten hingegen fort: Seine Mindestdauer beträgt 6 Monate und die maximale Dauer 2 Jahre und er kann nur mit Arbeitnehmern mit Universitätstitel (oder vergleichbarem Titel) abgeschlossen werden, soweit seit Abschluss des Studiums nicht mehr als 5 Jahre vergangen sind. Der Arbeitnehmer darf zudem nicht aufgrund desselben Studientitels bereits in demselben oder einem anderen Unternehmen mehr als 2 Jahre mit einem Praktikumsvertrag eingestellt gewesen sein, oder für denselben Posten in einem anderen Unternehmen, selbst wenn es sich um einen anderen Abschluss handelt.

[value] => Arranca el 2019 con novedades en el ámbito laboral. Se ha incrementado el salario mínimo interprofesional (SMI) en un 22,3%, la mayor subida en cuatro décadas, alcanzando los 900.-€ mensuales, lo que supone un aumento de 191,40 € respecto a 2018.
Ésto afecta, entre otros, al contrato en prácticas, cuyo objeto es permitir a los recién licenciados obtener la práctica profesional adecuada su nivel de estudios e iniciarse en el mundo laboral. Este contrato puede ser interesante para las empresas, pues prevé una retribución que en el primer año de su vigencia no podrá ser inferior al 60% y en el segundo año al 75% del salario establecido en el Convenio Colectivo (“CC”) aplicable. No obstante, la remuneración resultante de aplicar esos porcentajes al salario del CC nunca podrá ser inferior al SMI antes indicado. Como consecuencia, y teniendo en cuenta esta subida, las empresas que quieran celebrar contratos en prácticas deberán tener en cuenta este nuevo importe del SMI (en relación con las tablas del CC) a la hora de determinar el salario mínimo de los trabajadores con contrato de prácticas. Otra novedad consiste en la derogación, con efectos desde el 1 de enero de 2019, de los incentivos relacionados con estos contratos, que estaban vinculados a la tasa de desempleo en España, al situarse ésta por debajo del 15%. No obstante, queda por determinar lo qué pasará si la tasa de desempleo vuelve a subir.
En lo demás, siguen vigentes los requisitos para poder firmar este tipo de contratos: su duración mínima es de 6 meses y la máxima de 2 años y sólo podrán celebrarse siempre que el trabajador tenga un título universitario (o título equivalente) y que no hayan pasado más de cinco años desde la finalización de sus estudios. Asimismo, el trabajador no puede haber estado contratado bajo esta modalidad por más de dos años en la misma o distinta empresa por la misma titulación o en la misma empresa para el mismo puesto de trabajo, aunque se trate de distinta titulación.
