[value] => Der sogenannte Urlaubsabgeltungsanspruch - der Anspruch auf eine finanzielle Vergütung für bei Beendigung des Arbeitsverhältnisses nicht genommenen Jahresurlaub- geht mit dem Tod des Arbeitnehmers auf seine Erben über. Mit Urteil vom 22.01.2019 (Az. 9 AZR 45/19) hat sich das Bundesarbeitsgericht (BAG) damit der Auffassung des EuGH angeschlossen, nach der das Unionsrecht den Anspruch auf bezahlten Jahresurlaub als Vermögenswert (neben dem Erholungsaspekt) betrachtet, der auch im Wege der Erbfolge übergeht, wenn das Arbeitsverhältnis mit dem Tod des Arbeitnehmers erloschen ist.
Bisher hatte das BAG in seiner Rechtsprechung als Voraussetzung für die Vererbbarkeit des Abgeltungsanspruchs angenommen, dass der Arbeitnehmer das Ende des Arbeitsverhältnisses erlebt hat und der Anspruch somit unmittelbar bei ihm entstanden ist. Dieser Auslegung hat der EuGH mit seinem Urteil vom 06.11.2018 (Az. C-569/16 und C-570/16) auf die Vorlage des BAG im oben genannten Verfahren einen Riegel vorgeschoben. Es lag folgender Sachverhalt zugrunde: Die Witwe eines Arbeitnehmers, der bis zu seinem Tod im Jahr 2010 im öffentlichen Dienst der Stadt Wuppertal beschäftigt gewesen war, machte nach dessen Tod gegenüber der Stadt einen Betrag in Höhe von 5.857,75 Euro brutto zur Abgeltung von 25 Tagen bezahlten Jahresurlaubs geltend, die ihr Ehemann vor seinem Tod nicht genommen hatte.
Das BAG entschied sich nun dafür, der Klägerin in richtlinienkonformer Anwendung des Bundesurlaubsgesetzes den eingeklagten Abgeltungsanspruch anzuerkennen. Der Vergütungsanspruch umfasst demnach nicht nur den gesetzlichen Mindesturlaub von 24 Werktagen (ausgehend von einer Sechs-Tage-Woche), sondern auch den Anspruch auf Zusatzurlaub für schwerbehinderte Menschen sowie im konkreten Fall den tarifvertraglich anerkannten Mehrurlaub nach dem Tarifvertrag für den öffentlichen Dienst.

Así lo ha decidido el Bundesarbeitsgericht (BAG) en su sentencia del 22.01.2019 (Ref.: 9 AZR 45/19), conforme con la jurisprudencia del TJCE, ya que el Derecho de la UE considera el derecho a vacaciones anuales pagadas como un activo (además del aspecto recreativo). Este derecho, según establece el Tribunal, también pasará a los herederos si la relación laboral ha terminado debido a la muerte del empleado.
Según la jurisprudencia anterior del BAG, el derecho de compensación se incluía en la masa hereditaria tan solo cuando el empleado hubiera sobrevivido hasta el final de la relación laboral, es decir, él mismo lo hubiera adquirido. En su sentencia del 06.11.2018 (Ref.: C-569/16 y C-570/16) el TJCE ha rectificado esta interpretación del BAG, que había planteado una cuestión prejudicial ante el Tribunal Europeo. El pleito se basó en los siguientes hechos: La viuda de un empleado, el cual había trabajado en el servicio público de la ciudad de Wuppertal hasta su muerte en 2010, reclamó a la ciudad el pago de 5,857.75 euros brutos por 25 días de vacaciones anuales que su esposo no había disfrutado antes de su muerte.
En consecuencia, el BAG optó por una interpretación conforme a la directiva europea de la Ley Federal de Vacaciones y reconocer el derecho reclamado. El derecho incluye, como ha destacado el Tribunal, no solo las vacaciones anuales mínimas legalmente previstas de 24 días hábiles (en los casos de una semana de 6 días), sino también el derecho a vacaciones adicionales para las personas con discapacidad grave y, en este caso específico, las vacaciones adicionales reconocidas por el convenio colectivo para el servicio público.
