[value] => Ein ungeregelter Brexit wird nicht nur zu kilometerlangen Schlangen von LKWs führen, die in der Zollabfertigung zwischen dem europäischen Kontinent und Großbritannien stecken. Vielmehr sind Lieferbeziehungen und Lieferketten in vielfältigster Weise von einem No-Deal betroffen.
Neben Zöllen und Einfuhrumsatzsteuer, mit denen Lieferanten beim Export ihrer Waren nach Großbritannien zu rechnen haben werden, sind insbesondere vertragsrechtliche Bestimmungen zu überprüfen bzw. anzupassen. So finden sich in vielen Altverträgen Begriffe wie „Europäische Union“, z.B. als Vertriebsgebiet, und es stellt sich die Frage, ob in Zukunft das Gebiet des Vereinigten Königreichs noch dazu gehören wird. Wenn möglich, sollte umgehend eine Klarstellung zwischen den Vertragsparteien erfolgen.
Incoterms werden standardmäßig in grenzüberschreitenden Lieferverträgen verwendet. Solange Großbritannien der Europäischen Union angehört, ist dies im Bezug auf Zölle unbedenklich. Nach einem harten Brexit sollte aber in jedem Fall eine Klausel, wonach der Lieferant die anfallenden Zölle zu übernehmen hat, nicht mehr verwendet werden (dies gilt für die Klausel DDP = Delivered Duty Paid). In allen Branchen, in denen die Einfuhr von Produkten bestimmter Zulassungen oder Lizenzen bedarf (nicht zuletzt im Arzneimittel- oder Medizinproduktebereich), ist darauf zu achten, dass ab dem 29.03.2019 neue nationale Regelungen in Großbritannien maßgeblich sind, die eine Neuzulassung oder Genehmigung erfordern.
Auch das CE-Zeichen wird im Verhältnis zwischen Großbritannien und den 27 EU-Mitgliedsländern nicht mehr gelten.
Sofern noch nicht geschehen, sollten Unternehmen mit Lieferbeziehungen nach oder aus Großbritannien ihre bestehenden Vereinbarungen schnellstmöglich auf anstehende Veränderungen überprüfen.

[value] => Un Brexit no regulado no sólo ocasionará colas kilométricas de camiones atrapados en el despacho aduanero entre el continente europeo y Reino Unido. En realidad, las relaciones de suministro y las cadenas de suministro se verán afectadas de diversas formas por una falta de acuerdo.
Además de los derechos de aduana y el impuesto sobre el valor añadido sobre la importación, que los proveedores deberán tener en cuenta al exportar sus productos a Reino Unido, en particular, las disposiciones contractuales deberán revisarse o adaptarse. Así, en muchos contratos antiguos se encuentran términos como “Unión Europea”, p.ej. como territorio de ventas, y se plantea la pregunta de si en el futuro el territorio del Reino Unido seguirá perteneciendo a ello. Cuando sea posible, deberá realizarse una aclaración entre las partes contractuales.
Los incoterms se utilizan de forma estándar en los contratos de suministro transfronterizos. Mientras Reino Unido pertenece a la UE esto no supone ningún obstáculo en relación a los impuestos aduaneros. Sin embargo, en el supuesto de un Brexit duro no será posible en cualquier caso utilizar mas una cláusula según la cual el proveedor asume los aranceles aduaneros resultantes (esto se aplica para la cláusula DDP = Delivered Duty Paid).
En todos los sectores donde la importación de productos requiere autorizaciones o licencias específicas (especialmente en el sector farmacéutico o de dispositivos sanitarios), deberá prestarse especial atención a las nuevas normativas nacionales en Reino Unido que exigen una autorización o licencia y que serán determinantes a partir del 29-03-2019.
También dejará de ser aplicable el símbolo CE en las relaciones entre Reino Unido y los 27 Estados miembros de la UE.
Si aún no se ha hecho, las empresas que mantengan relaciones de suministro con Reino Unido deberán revisar lo más rápido posible los acuerdos existentes atendiendo a los cambios próximos.
