[value] => Die katalanische Regierung, die Generalitat, hat mit dem Gesetz 6/2017 vom 9. Mai über die Besteuerung von nicht produktiven Vermögenswerten eine Steuer eingeführt, die sowohl Gesellschaften als auch Unternehmen, die keine juristischen Personen sind, aber einen kaufmännischen Zweck verfolgen, zwingt, ihre Vermögenswerte (einschließlich der daraus resultierenden Rechte) zu versteuern. Die Steuer fällt an, wenn der Vermögenswert nichts mit der wirtschaftlichen Tätigkeit des Unternehmens zu tun hat, sondern persönlichen Zwecken der Gesellschafter dient. Wichtig ist, dass dieses Gesetz nicht nur Vermögensverwaltungsgesellschaften gemäß der Definition im spanischen Körperschaftssteuergesetz betrifft. Vielmehr findet es auch auf solche Gesellschaften Anwendung, die zwar mehr als die Hälfte ihrer Aktiva ihrer wirtschaftlichen Tätigkeit zuordnen, aber eben auch Vermögenswerte besitzen, die nicht ihrer wirtschaftlichen Tätigkeit dienen.
Mit Urteil vom 28.02.2019 hat das spanische Verfassungsgericht die Verfassungsmäßigkeit der Steuer festgestellt. Bislang hatte die Generalitat die Steuer noch nicht eingefordert. Nunmehr hat sie jedoch eine Norm erlassen, die für die bereits abgeschlossenen Veranlagungszeiträume 2017, 2018 und 2019 die Abgabe einer Steuererklärung vorschreibt. Die Frist für die Einreichung der Steuererklärungen läuft vom 01.10 bis 30.11.2019. Besteuert werden die unproduktiven Vermögenswerte der Unternehmen zum Stichtag 30.06.2017 für die Steuererklärung 2017 sowie 1. Januar für die Steuererklärungen der beiden folgenden Jahre.
Abschließend ist darauf hinzuweisen, dass die nicht produktiven Vermögenswerte in Katalonien belegen sein müssen, damit sie von der Steuer erfasst werden. Es liegt auf der Hand –außer vielleicht für die Generalitat–, dass es schwierig werden wird, den Standort beweglicher Vermögenswerte zu bestimmen. Dies liegt in der Natur der Sache. Es sieht also so aus, als ob die meisten Selbstveranlagungen Immobilien betreffen werden. Immobilien werden mit ihrem im katalanischen Haushaltsgesetz aktualisierten Katasterwert bewertet.

[value] => La Generalitat de Cataluña, mediante la promulgación de la Ley 6/2017, de 9 de mayo, del Impuesto sobre los Activos No Productivos de las Personas Jurídicas, creó el impuesto que obliga a las sociedades o entidades sin personalidad jurídica con objeto mercantil a gravar los bienes y derechos que recaigan sobre estos, siempre y cuando no estén afectos a la actividad económica y sean utilizados para fines personales de los socios. Esta Ley, es importante destacar, afecta no sólo a las sociedades patrimoniales (aquéllas que la Ley del Impuesto de Sociedades define por no tener afecto a actividad económica la mitad de su activo) sino también, a aquellas sociedades que aunque tienen más de la mitad de su activo afecto a actividad económica, disponen también de bienes que no lo están.
Tras la declaración de constitucionalidad del Impuesto, fallada por el Tribunal Constitucional el 28 de febrero de 2019, la Generalitat ha promulgado una nueva norma que obliga a la presentación de la autoliquidación del Impuesto para los ejercicios ya devengados pero no exigidos, esto es, los ejercicios 2017, 2018 y 2019. El plazo para presentar la autoliquidación del Impuesto es del 1 octubre al 30 de noviembre del año 2019 y el objeto de la autoliquidación serán los bienes improductivos que las empresas tenían a 30 de junio de 2017 para la declaración del año 2017 y a 1 de enero para los sucesivos ejercicios.
Por último, señalar que tales bienes improductivos, para ser susceptibles de ser gravados con el nuevo Impuesto, deben estar ubicados en Cataluña. Siendo evidente –salvo quizás para la Generalitat- la dificultad práctica que reviste fijar y/o determinar la localización de los bienes muebles -por la propia naturaleza de éstos-, todo parece apuntar que el grueso de las autoliquidaciones versará acerca de los bienes inmuebles, debiéndose estos valorar por su valor catastral actualizado en la correspondiente Ley de presupuestos.
