[value] => Richter öffnen sich mehr und mehr für die digitale Welt und die neuen Erfordernisse, die sich aus ihr ergeben haben. Daher stufen Richter seit einiger Zeit die Informationen aus dieser digitalen Welt, wie beispielsweise Lokalisierungsdaten von Google Maps, als zuverlässig ein.
Das jüngste Beispiel der Zulassung dieser Art von Beweisen findet sich in dem Urteil, welches das Landgericht Zaragoza (Audiencia Provincial de Zaragoza) im Mai 2019 verkündete. In diesem neuartigen Urteil verliehen die Richter dem von einer nordamerikanischen App erstellten Bericht volle Beweiskraft. Diese App speichert Kopien der meisten Webseiten, dadurch konnte das Tribunal herausfinden, ob der strittige Inhalt geändert und/oder gelöscht wurde. Durch die Einordnung der App als „unbeteiligten Dritten“ setzt dieses bahnbrechende Urteil neue Maßstäbe. Diese Klassifizierung als unbeteiligten Dritten rührt aus dem Verständnis her, dass der Inhalt der App automatisch erstellt wird und dieser nicht manipuliert werden kann und ferner die App auch in keinerlei Beziehung zu den Streitparteien steht.
Diese Entwicklungen deuten darauf hin, dass immer mehr Beweise aus der digitalen Welt nicht nur zugelassen werden, sondern diese von den Richtern auch als voll beweiskräftig eingestuft werden, da sie von ihnen als zuverlässig angesehen werden.

[value] => Es una realidad que los jueces cada vez más se están abriendo al entorno digital y a las necesidades nuevas que en dicho entorno han surgido. Por este motivo, los jueces vienen otorgando plena fiabilidad a la información surgida en este “mundo digital”, como, por ejemplo, es el caso de los datos de localización derivados de la aplicación Google Maps.
La más reciente admisión de este tipo de pruebas la encontramos en una sentencia de la Audiencia Provincial de Zaragoza del pasado mes de mayo. Se trata de una sentencia novedosa en la que los jueces otorgan plena validez al informe emitido por una aplicación norteamericana cuya actividad consiste en almacenar las copias de la mayoría de sitios web. Estas copias realizadas por la citada aplicación han permitido al tribunal conocer si el contenido controvertido fue modificado y/o eliminado. Estamos ante una sentencia revolucionaria porque el tribunal ha otorgado a esta aplicación la condición de “tercero imparcial” por entender que, al ser automática, su contenido no puede ser manipulado y porque, además, carece de vínculos con las partes litigantes.
En definitiva podemos concluir que, cada vez más, las pruebas surgidas en un entorno digital vienen no solo siendo admitidas en los litigios sino que, además, los jueces les vienen concediendo plena validez al considerarlas suficientemente fiables.
