[value] => Derzeit handelt es sich bei ca. 25% der Arbeitsverträge in Spanien um befristete Verträge. Daher ist es wichtig, ihre Anforderungen zu kennen, um den Abschluss rechtsmissbräuchlicher Verträge zu vermeiden, die eine Umwandlung in eine unbefristete Beschäftigung zur Folge hätten. Der Abschluss eines befristeten Vertrages ist nur in folgenden gesetzlichen Fällen zulässig: Der erste Fall ist die Ausführung eines bestimmten Projekts oder einer Dienstleistung mit Autonomie und Substantivität innerhalb der Tätigkeit des Unternehmens, deren Dauer 3 Jahre nicht überschreiten darf (tarifvertraglich erweiterbar auf 4 Jahre).
Der zweite Fall bezieht sich auf eine Befristung aufgrund von Marktgegebenheiten, Arbeitsrückstand oder Auftragshäufung, mit einer Maximaldauer von 6 Monaten in einem Zeitraum von 12 Monaten, wobei dies tarifvertraglich geändert werden kann. Der letzte Fall ist der Vertretungsvertrag, durch den ein Arbeitnehmer eingestellt wird, um vorübergehend einen anderen Arbeitnehmer mit geschütztem Arbeitsplatz zu ersetzen. In allen Fällen muss der Vertrag zu seiner Wirksamkeit schriftlich abgeschlossen werden, wobei der Sachverhalt anzugeben ist, der die Befristung rechtfertigt. Temporäre Verträge enden durch Kündigung nach Ablauf der vereinbarten Zeit oder nach Erbringung des Projektes oder der Dienstleistung, die bei Verträgen mit einer Dauer von mehr als einem Jahr mit einer Vorfrist von 15 Tagen mitzuteilen ist.
Bei Vertragsbeendigung hat der Arbeitnehmer Anspruch auf eine Abfindung iHv 12 Tagesgehältern pro Jahr der Betriebszugehörigkeit, außer bei Vertretungsverträgen, die keine Abfindung vorsehen. Dieser Unterschied wurde jüngst vom Obersten Gerichtshof in seinem Urteil vom 13. März 2019 bestätigt, in dem festgestellt wird, dass es sich nicht um identische Situationen handelt, da im Falle einer vorübergehenden Ersetzung wird der Arbeitsplatz mit dem Ausscheiden des Vertreters nicht beseitigt, sondern besteht fort und wird vom Arbeitnehmer mit Recht auf Schutz seines Arbeitsplatzes besetzt.

[value] => Actualmente cerca del 25% de los contratos laborales en España son temporales. Por ello, es importante conocer sus requisitos para evitar contratos celebrados en fraude de ley, lo que implicaría que el trabajador adquiriese la condición de indefinido. La celebración de un contrato de duración determinada solo se permite en los siguientes supuestos legales: El primero es la realización de una obra o servicio determinado, con autonomía y sustantividad propia dentro de la actividad de la empresa, cuya duración no puede ser superior a 3 años (ampliable a 4 años por el convenio colectivo aplicable).
El segundo supuesto se refiere al contrato eventual por circunstancias del mercado, acumulación de tareas o excesos de pedidos, con una duración máxima de 6 meses, en un periodo de referencia de 12 meses, aunque el convenio aplicable pueda modificar este límite temporal. El último supuesto es el contrato de interinidad, mediante el cual se contrata a un trabajador para sustituir temporalmente a otro trabajador con reserva de su puesto de trabajo. En todos los casos, para su validez, el contrato debe realizarse por escrito, indicando el supuesto que justifique la duración determinada del contrato. Los contratos temporales se extinguen por expiración del tiempo convenido o realización de la obra o servicio, previa denuncia, que en los casos de contratos de una duración superior a un año se tiene que notificar con 15 días de preaviso.
A la finalización del contrato, el trabajador tendrá derecho a una indemnización de 12 días de salario por año trabajado, salvo en los contratos de interinidad, donde no se prevé compensación alguna. Dicha diferencia acaba de ser confirmada por el Tribunal Supremo en su sentencia de 13 de marzo de 2019, que establece que se trata de situaciones no idénticas, ya que en el caso de la interinidad por sustitución el puesto de trabajo no desaparece con el cese del interno, sino que sigue existiendo, estando cubierto por el empleado con derecho a reserva de puesto.
