[value] => Das Verfassungsgericht stellt in seinem Urteil vom 17. Januar diesen Jahres fest, dass das Fehlen einer elektronischen Benachrichtigung über den Erhalt einer gerichtlichen Zustellung auf der LexNET-Plattform nicht verhindert, dass die Zustellung als erfolgt angesehen wird. Die Zivilprozessordnung erlaubt es dem Empfänger der LexNET-Kommunikation, ein “elektronisches Gerät, einen einfachen Nachrichtendienst oder eine E-Mail-Adresse” anzugeben, damit das Gericht ihn über den Erhalt von Zustellungen benachrichtigen kann. Das Gesetz selbst besagt jedoch, dass “die mangelnde Praxis dieser Benachrichtigung nicht verhindert, dass die Zustellung als gültig angesehen wird.“
In seinem Urteil stellt das Verfassungsgericht ebenso fest, dass keine Unvereinbarkeit mit dem Grundrecht auf effektiven Rechtsschutz besteht, indem es die Gültigkeit der Zustellung von einer bereits erfolgten Gerichtskommunikation mit der Verletzung der Verpflichtung des Gerichtsorgans, eine Benachrichtigung über LexNET zu übermitteln, trennt. Der akzessorische Charakter der Benachrichtigung des Gerichtsamts über die erfolgte Zustellung unterstützt diese Argumentation, da es sich bei der Benachrichtigung über LexNET nur um ein Instrument handelt, das hilft oder die Kenntnis der Tatsache erleichtert, dass eine gerichtliche Zustellung erfolgte.
Zudem verweist das Urteil darauf, dass das Verlangen der ständigen Überprüfung der LexNET-Mailbox aufgrund der Anzahl und Art der Rechtsangelegenheiten, die die Vertreter der Justiz bearbeiten, nicht als “sehr exorbitante Verpflichtung” qualifiziert werden kann, da es eine freie Option ist, in anderen Gerichtsbezirken als denjenigen zu handeln, in denen sie gemeldet sind, und dass es in ihrer Verantwortung liegt, ihre Arbeit zu rationalisieren. Das Ersetzen des gegenwärtigen Empfangssystems von Gerichtszustellungen durch eine andere elektronische Art stellt kein rechtliches Hindernis für das Wohlergehen von Prozessagenten, Sozialrechtsberatern oder Rechtsanwälten dar.

[value] => El Tribunal Constitucional ha declarado en su sentencia de 17 de enero de 2019 que la falta de aviso electrónico de una notificación en la plataforma LexNET no impide que la notificación sea considerada plenamente válida. La Ley de Enjuiciamiento Civil permite al destinatario de la comunicación en LexNET identificar un “dispositivo electrónico, servicio de mensajería simple o una dirección de correo electrónico” para que la oficina judicial le pueda avisar de las notificaciones realizadas. Sin embargo, la propia ley establece que “la falta de práctica de este aviso no impedirá que la notificación sea considerada plenamente válida”.
El TC, asimismo, declara en su sentencia que no existe incompatibilidad con el derecho fundamental a la tutela judicial efectiva, ya que desvincula la validez de la notificación de un acto de comunicación ya practicada con el incumplimiento de la obligación que tiene a su vez el órgano judicial de enviar un aviso al destinatario para que sepa que se ha producido dicha notificación. El carácter accesorio del aviso efectuado por la oficina judicial apoya a esta tesis, ya que el aviso es solo un instrumento que ayuda o facilita el conocimiento del hecho de haberse practicado un acto de comunicación.
Además, la sentencia señala que no se puede calificar como una “obligación muy exorbitante” el tener que consultar el buzón de LexNET con la asiduidad que exija el número y naturaleza de los asuntos judiciales que tienen a su cargo los profesionales de la Justicia, ya que es siempre una opción libre del profesional el actuar en partidos judiciales distintos a aquel donde está colegiado, y que suya es la responsabilidad de racionalizar su trabajo. No constituye ningún obstáculo legal para el bienestar de procuradores, graduados sociales o abogados, el que se sustituya el régimen presencial diario en la recepción de los actos de comunicación por otro de naturaleza.
