[value] => Entschädigungs- oder Schadensersatzleistungen die nicht für eine Lieferung oder sonstige Leistung an den Zahlenden erfolgen, sondern weil der Zahlende nach Gesetz oder Vertrag für einen Schaden und seine Folgen einzustehen hat, unterliegen unabhängig von ihrer Bezeichnung nicht der Umsatzsteuer (sog. echter Schadensersatz). Ist die Ersatzleistung jedoch tatsächlich die – wenn auch nur teilweise – Gegenleistung für eine Lieferung oder sonstige Leistung, so handelt es sich um ein Entgelt im Rahmen eines umsatzsteuerbaren Leistungsaustauschs (sog. unechter Schadensersatz).
In einem jüngst veröffentlichten Urteil vom 12.02.2019 (BFH XI R 1/17) hat der Bundesfinanzhof (BFH) entschieden, dass Abmahnungen, die der Inhaber von Rechten zur Durchsetzung eines urheberrechtlichen Unterlassungsanspruchs gegenüber Personen vornimmt, die Tonauf-nahmen im Internet rechtswidrig verbreitet haben, als umsatzsteuer-pflichtige Leistungen zu beurteilen sind. Denn die Abmahnung erfolge zumindest auch im Interesse des Rechtsverletzers, weil dieser mit Abgabe einer Unterlassungserklärung die Möglichkeit erhalte, einen kostspieligen Rechtsstreit zu vermeiden. Zahlungen, die als Aufwendungsersatz für die Inanspruchnahme von anwaltlichen Leistungen im Zusammenhang mit Abmahnungen geleistet werden, seien daher umsatzsteuerrechtlich als Entgelt zu qualifizieren.
Für dieses Ergebnis ist es nach Auffassung des BFH unerheblich, dass im Zeitpunkt der Abmahnung nicht sicher feststand, ob die Abmahnung erfolgreich sein werde. Auch wenn ungewiss ist, ob die abgemahnte Person ein Rechtsverletzer sei und zahlen werde, bestehe ein unmittelbarer Zusammenhang zwischen der Abmahnung als sonstiger Leistung und der dafür erhaltenen Zahlung. Auf welche Rechtsgrundlage der Zahlungsanspruch gestützt wird, spielt nach dem Urteil umsatzsteuerlich ebenfalls keine Rolle. Damit überträgt der BFH seine ständige Recht-sprechung zu Abmahnungen nach dem Gesetz gegen den unlauteren Wettbewerb auf Abmahnungen nach dem Urheberrechtsgesetz.

[value] => Indemnizaciones y compensaciones por daños y perjuicios, que no provienen de una entrega o prestación de servicios hecha a pagadores sino de una reclamación justificada por ley o contrato, no están sujetas al IVA, independientemente de su denominación (“indemnización típica”). Si en cambio la compensación – aunque no fuese en su totalidad – es una remuneración por una entrega o un servicio, se trata de una contraprestación en el marco de una operación sujeta al IVA (“indemnización atípica en una sentencia recién publicada del 12/02/2019, el Tribunal Federal Supremo de lo Fiscal (BFH XI R 1/17) decidió que las cartas de advertencia por infracción de derechos de autor, que contienen una pretensión de omisión y fueron enviadas a personas que han hecho circular grabaciones de sonidos en Internet de manera ilegal, deben ser calificadas como operaciones sujetas al IVA.
Además, dichas advertencias son también de interés por parte del destinatario infractor, pues al posibilitar una declaración de prescindir de actividades ilegales, pueden evitar un pleito costoso. Asimismo, los pagos que corresponden a la compensación de honorarios por contratación de servicios jurídicos en relación a dichas advertencias deben considerarse en términos de IVA como contraprestaciones. El BFH considera no relevante que a la fecha de la emisión de la advertencia no sea posible determinar con seguridad si será exitosa o no. Tampoco que sea incierto que la persona advertida sea realmente un infractor y que pagará, pues existe una relación entre la advertencia, que debe calificarse como prestación de un servicio y la correspondiente realización del pago. La base jurídica del derecho de indemnización tampoco es relevante a los efectos de IVA. De este modo traslada el BFH su doctrina consolidada sobre advertencias basadas en la Ley contra la Competencia Desleal a advertencias basadas en la Ley sobre los Derechos de Autor.
