Dezember 2018 hat der Gerichtshof der Europäischen Union (EuGH) in der Sache Alpenchalets Resorts GmbH ein Urteil erlassen, in welchem er klarstellt, welcher Mehrwertsteuersatz auf Beherbergungsleistungen, die der Sonderregelung für Reisebüros unterliegen, anzuwenden ist. Alpenchalets GmbH mietet Wohnungen von Drittparteien an, um sie anschließend zu Urlaubszwecken zu vermieten. Neben der Bereitstellung der Unterkunft gehören zu den Leistungen auch Reinigung sowie ein Wäsche- und Brötchenservice. Das Unternehmen stellte bei der deutschen Steuerverwaltung einen Antrag auf Berichtigung der Steuererklärungen, um den ermäßigten Steuersatz anzuwenden.
Der EuGH ist der Ansicht, dass die von einem Reisebüro zur Verfügung gestellte Ferienwohnung, mit oder ohne zusätzliche Leistungen, eine einheitliche Dienstleistung darstellt, die unter die Sonderregelung für Reisebüros (SRfRB) fällt. Mit diesem letzten Urteil folgt der EuGH den in den Urteilen Van Gikel, Minerva Kulturreisen und MyTravel bereits festgelegten Kriterien, in dem er die Vermietung von Ferienwohnungen als eine einheitliche Dienstleistung behandelt, die unter die SRfRB fällt, ohne dass es ein Reisebüro sein muss.
Der Gerichtshof gelangt zu der Auffassung, dass die Dienstleistung zur Beherbergung in Ferienunterkünften seitens der Reisebüros nicht dem ermäßigten Mehrwertsteuersatz unterliegen kann.
Im gleichen Sinne hat die spanische Generaldirektion Steuern in der bindenden Konsultation V1569-18 die an Studenten erbrachten Beherbergungs-dienstleistungen in Verbindung mit Freizeitaktivitäten als einheitliche Dienstleistungen, die unter die SRfRB fallen, betrachtet, so dass diese mit 21% auf die Bruttomarge der Transaktionen besteuert werden müssen.
Dieses Urteil hat heutzutage aufgrund des exponentiellen Wachstums der Vermietung von Ferienwohnungen und den damit verbundenen Vermittlern eine besondere Bedeutung, da diese eventuell der Verpflichtung unterliegen, als Reisebüro Steuern zu entrichten, obgleich sie die Tätigkeit eines Reisebüros nicht ausüben.

[value] => Con fecha 19 de diciembre del 2018, el Tribunal de Justicia de la Unión Europea dictó sentencia en relación con el asunto Alpenchalets Resorts GmbH, aclarando cuál debía ser el tipo de IVA aplicable a los servicios de alojamiento prestados bajo el régimen de agencias de viaje. Alpenchalets GmbH arrienda viviendas de terceros para poder después subarrendarlas con fines vacacionales a particulares, prestando conjuntamente con el alojamiento, servicios de lavandería, limpieza y de panadería. La entidad solicitó a la Administración Tributaria alemana la rectificación de las declaraciones con el fin de aplicar el tipo impositivo reducido.
El TJUE concluye que la mera puesta a disposición por una agencia de viajes de un inmueble vacacional con o sin prestaciones adicionales constituye un servicio único comprendido en el Régimen Especial de las agencias de viaje (“REAG”). A través de esta última sentencia, el TJUE sigue los criterios que ya había establecido en las sentencias Van Gikel, Minerva Kulturreisen y MyTravel al tratar el alquiler vacacional y el alojamiento turístico como un servicio único comprendido en el REAG, sin necesidad de ser agencia de viaje.
El Tribunal resuelve que la prestación de servicios de provisión de alquileres vacacionales por agencias de viaje no puede someterse al tipo reducido del IVA.
En el mismo sentido la Dirección General de Tributos, en su consulta V1569-18, ha considerado los servicios de alojamiento, conjuntamente con actividades lúdicas, prestados a alumnos como prestaciones de servicio únicas en el REAG y, por consiguiente, debiendo tributar al 21% sobre el margen bruto de las operaciones.
Esta sentencia adquiere especial relevancia hoy en día debido al crecimiento exponencial del alquiler vacacional de viviendas y de los intermediarios relacionados con ellas pudiendo estos estar en la obligación de tributar en REAG aún sin desarrollar la actividad de agencia de viaje propiamente dicha.
