[value] => In einem jüngst veröffentlichten Urteil von 22.11.2018 (BFH V R 65/17) hat der Bundesfinanzhof unter Aufgabe seiner bisherigen Rechtsprechung entschieden, dass eine sog. Gemeinschaft nach Bruchteilen, bei der ein Recht mehreren natürlichen oder juristischen Personen gemeinschaftlich zusteht (wie z.B. bei der Gemeinschaft der Miteigentümer eines Grundstücks), nicht Unternehmer im umsatzsteuerlichen Sinn sein kann.
Als Unternehmer seien vielmehr die jeweiligen Mitglieder der Gemeinschaft anzusehen, die anteilig die von ihnen erbrachten Leistungen (z.B. Vermietung des gemeinschaftlichen Grundstücks) zu versteuern hätten.
Korrespondierend seien beim Bezug von Leistungen für das gemeinschaftliche Recht stets die jeweiligen Mitglieder der Gemeinschaft als Leistungsempfänger zum Abzug der nach Maßgabe ihrer Beteiligung anteilig auf sie entfallenden Vorsteuer berechtigt. Das Recht auf Vorsteuerabzug könne sich hierbei gleichermaßen aus der eigenunternehmerischen Verwendung des gemeinschaftlichen Rechts durch das jeweilige Mitglied oder aus einem gemeinsamen Handeln der Mitglieder der Gemeinschaft durch gemeinsame Nutzung des Rechts gegenüber Dritten ergeben. Umsatzsteuerlich sei Unternehmer im Sinne von § 2 UStG nur derjenige, der selbst entgeltliche Leistungen erbringe, wobei sich die Person des Leistungserbringers nach den der Leistung zugrundeliegenden Rechtsverhältnissen bestimme.
Zivilrechtlich könne eine Gemeinschaft nach Bruchteilen (§§ 741 ff. BGB) aber keine Trägerin von Rechten und Pflichten sein und damit weder selbst noch durch Vertreter am Rechtsverkehr teilnehmen. Gläubiger einer von der Gemeinschaft zu erbringenden Leistung seien gemäß §§ 420, 432 BGB vielmehr die Mitglieder der Gemeinschaft. Verfahrensrechtlich könne sowohl auf der Eingangsseite als auch auf der Ausgangsseite eine verbindliche Aufteilung auf die Mitglieder der Gemeinschaft über die gesonderte Feststellung von Besteuerungsgrundlagen nach § 180 Abs. 2 AO i.V.m. § 1 Abs. 2 der Verordnung über die gesonderte Feststellung von Besteuerungsgrundlagen erreicht werden.

[value] => En la sentencia recién publicada el 22/11/2018 (BFH V R 65/17) del Tribunal Federal Supremo de lo Fiscal se abandona la jurisprudencia aplicada siendo ahora los miembros de las llamadas comunidades de bienes, en las cuales personas físicas o jurídicas disponen de un derecho comunitario (p.ej. al ser copropietarios de un inmueble), considerados empresarios a los efectos del IVA.
De ahora en más serían los correspondientes miembros de dicha comunidad tratados como empresarios y que deberían declarar los resultados de las operaciones realizadas (p.ej. arrendamiento del bien compartido).
Asimismo, aquellas operaciones destinadas al derecho común gozarían del derecho de deducción del IVA soportado por cada miembro como destinatario según sea su participación al ser el mismo especificado como tal. El derecho de deducción del IVA soportado podría darse de igual manera de la determinación del beneficio propio según el derecho común a través de cada miembro o bien del derecho de comercializar como miembro obteniendo un beneficio de terceras partes. A efectos del IVA sería un empresario en razón del art. (§) 2 UStG (Ley alemana del Impuesto sobre el IVA) solamente quien opere por su propia cuenta, si bien dicha persona se determina según la relación jurídica a ser aplicada.
En términos civiles, una comunidad de bienes (§§ 741 et seq. del Código Civil alemán - BGB) no podría ser titular de derechos y obligaciones y por ello no podría, por sí misma o a través de terceros, contratar jurídicamente. Según los artículos (§§) 420, 432 BGB también serían los miembros los mismos acreedores de una prestación ofrecida por la comunidad. Por la ley procesal podría definirse la tributación correspondiente tanto al emisor como al destinatario de la operación entre los miembros de una comunidad de bienes de manera vinculante en base del art. (§) 180 Abs. 2 AO de la LGT alemana en relación con el art. (§) 1 pár. 2 de la Normativa Fiscal sobre el trato especial para definir la base imponible.
