[value] => Am vergangenen 16. März hat der spanische Staatsanzeiger das Gesetz 5/2019 über Immobilienkreditverträge veröffentlicht, welches wichtige Neuerungen im Bereich der Hypothekendarlehen einführt.
Das erwähnte Gesetz, irrtümlicherweise häufig „neues Hypothekengesetz“ genannt,dient u.a. zur Umsetzung der Richtlinie 2014/17/EU des Europäischen Parlaments und des Rates über Wohnimmobilienkreditverträge für Verbraucher. Das Gesetz tritt am 16. Juni 2019 in Kraft und ist, mit Ausnahme der Vorschriften betreffend vorzeitiger Fälligkeit, nur auf Kreditverträge anwendbar, die nach dem erwähnten Datum zustande kommen.
Zur vorzeitigen Fälligstellung führt das Gesetz, in Anlehnung an Modelle unseres Umfelds, wie z.B. das deutsche oder das italienische, folgende Neuerungen ein: Die Laufzeit des Vertrags wird in zwei Hälften eingeteilt. Wenn der Zahlungsverzug während der ersten Hälfte eintritt, kann der Kreditgeber den gesamten Restbetrag nur dann fällig stellen, wenn der Kreditnehmer mit mehr als 3% des Kreditbetrags in Verzug ist und mindestens 12 Raten unbezahlt geblieben sind. Tritt der Zahlungsverzug während der zweiten Hälfte der Laufzeit ein, müssen mindestens 7% des Kreditbetrags und 15 Raten unbezahlt geblieben sein. Andere wichtige Neuheiten sind folgende:
- Die sogenannten Mindestzinsklauseln („cláusulas suelo“), mithilfe derer bei Hypothekendarlehen mit variablem Zinssatz ein Mindestzinssatz festgelegt wird, werden ausdrücklich verboten.
- Der Steuersatz der Stempelsteuer wird auf 0% gesetzt, womit diese Steuer in der Praxis nicht mehr existiert.
- Die Notar-, Grundbuch – und Servicedienstleisterkosten, die bei der Formalisierung des Kreditvertrags entstehen, sind vom Kreditgeber zu tragen. Der Kreditnehmer trägt die Kosten für die Wertschätzung der Immobilie.
Es handelt sich folglich um ein Gesetz zur Stärkung des Verbraucherschutzes und zur Einführung von Maβnahmen zur Verbesserung der Transparenz und der Werbung im Bereich von hypothekarisch besicherten Kreditverträgen.
[summary] => [format] => full_html ) ) [x-default] => Array ( [0] => Array ( [value] =>El pasado día 16 de marzo se publicó en el BOE la Ley 5/2019, reguladora de los contratos de crédito inmobiliario, que introduce importantes novedades en el ámbito de la contratación de préstamos hipotecarios.
Dicha Ley, llamada en muchas ocasiones de forma errónea «nueva ley hipotecaria», tiene su fundamento en la trasposición, entre otras, de la Directiva 2014/17/UE del Parlamento Europeo y del Consejo sobre los contratos de crédito celebrados con los consumidores para bienes inmuebles de uso residencial.
La Ley entrará en vigor el próximo día 16 de junio de 2019 y se aplicará únicamente a los contratos de préstamos suscritos a partir de dicha fecha, excepto en lo que se refiere al vencimiento anticipado en caso de impago.
Precisamente a este respecto encontramos la primera novedad importante: la nueva normativa, inspirada en modelos de nuestro entorno, como el alemán o el italiano, divide la vida del préstamo en dos mitades. Si el impago se produce dentro de la primera mitad de la vida del préstamo, el impago ha de ser igual o superior al 3% del capital o han de dejarse impagadas al menos 12 cuotas para que la entidad prestamista pueda declarar el vencimiento anticipado de la totalidad del préstamo. Si es durante la segunda mitad, el impago debe ser de al menos el 7% o de al menos 15 cuotas. Otras importantes novedades son las siguientes:
- Se prohíben expresamente las llamadas «cláusulas suelo», consistentes en la aplicación de un tipo de interés mínimo en las hipotecas con tipo de interés variable.
- El tipo aplicable correspondiente al IAJD queda establecido en el 0%, por lo que en la práctica queda eliminado.
- En cuanto a los gastos que se generen como consecuencia de la formalización del préstamo, es el prestamista el que debe abonar los gastos de Notaría, Registro y gestoría. El prestatario abonará la tasación del inmueble.
En definitiva, se trata de una norma que pretende otorgar mayor protección al consumidor e imponer mayores medidas de transparencia y publicidad en lo referido a los préstamos con garantía hipotecaria.
