[value] => Im Februar entschied das Bundeskartellamt, dass Facebook nicht mehr automatisch Daten zwischen seinen Diensten WhatsApp und Facebook verknüpfen darf. Durch das Verknüpfen der Daten missbrauche Facebook seine marktbeherrschende Stellung.
Die Daten in Deutschland ansässiger Nutzer seien als Wettbewerbsfaktor für die Prüfung seitens des Bundeskartellamts maßgebend. Verbraucher würden durch die Wahl zwischen Benutzung der Plattform Facebook mit der einhergehenden Verknüpfung der Daten samt Einwilligung durch die enthaltene AGB-Klausel und der Alternative, die Plattform nicht nutzen zu können, ausgebeutet. Indes seien Wettbewerber im Rahmen dieses kartellrechtlichen Verstoßes dem Nachteil ausgesetzt, dass diese gerade nicht Daten in diesem Umfang sammeln könnten.
Unter Berücksichtigung der Begründung diskutiert man, ob eine Verletzung datenschutzrechtlicher Vorschriften durch ein marktbeherrschendes Unternehmen automatisch zu einem kartellrechtlichen Verstoß führe und ob das Bundeskartellamt mit Hinsicht auf die Datenschutzbehörden überhaupt für die Prüfung zuständig ist. Ein solcher Automatismus ist nach derzeitigem Stand nicht anzunehmen. Problematisch ist mit Sicht auf zukünftige Fälle, wann ein außerkartellrechtlicher Verstoß auf der Ausübung der Marktmacht beruht. Hierzu wird allerdings die Ansicht vertreten, dass einer kartellrechtlichen Prüfung stets auch ein Verstoß gegen das kartellrechtliche Missbrauchsverbot zugrunde zu liegen hat. Eine marktbeherrschende Stellung mit Verletzung außerkartellrechtlicher Normen reiche gerade nicht aus.
Zur Frage der Zuständigkeit fiel mangels datenschutzrechlichen Verstoßes eine Begründung aus. Eine Annahme der Zuständigkeit des Bundeskartellamts stützt die fehlende Sachkenntnis der Datenschutzbehörden in Bezug auf das Kartellrecht. Zumal die Prüfung originär dem Bundeskartellrecht obliegt. Sollte Facebook gegen die Entscheidung vorgehen, geht man von einer Begriffsschärfung durch das Gericht aus.

Los datos de usuarios establecidos en Alemania, como factor de competitividad, se han considerado como decisivos para la evaluación. Se considera abusivo cuando el consumidor únicamente tiene la opción de abstenerse del uso de la plataforma, en caso de no querer dar su consentimiento al intercambio de datos tras aceptar las condiciones generales. Los competidores, por esta infracción del derecho de carteles, se veían en desventaja al no poder recopilar datos en el mismo alcance.
Se está planteando la cuestión si una infracción de la normativa sobre la protección de datos por una empresa dominante en el mercado conduce automáticamente a una infracción del derecho de la competencia, y si, de primero, la Ofic. Fed. Antimonopolio Alemana es la competente para estos asuntos o el organismo responsable para la protección de datos. Actualmente, es incomprensible tal automatismo.
En el futuro estarán a debate los casos en los que una infracción fuera del ámbito del derecho de la competencia se basa en un abuso debido a una posición dominante en el mercado. Hay opiniones que defienden, que, para que pueda haber un procedimiento sancionador en el ámbito de los carteles, debe cometerse una infracción de la normativa sobre carteles. Se argumenta, que una posición dominante, en la que se han infringido normas que no son del ámbito del derecho de la competencia, no puede causar una infracción del derecho de la competencia.
No hubo una pronunciación respecto a la cuestión de la competencia de la Ofic. Fed. Antimonopolio de Alemania por falta de una infracción de normas de protección de datos. Visto la falta de conocimiento sobre el derecho de la competencia de las agencias de protección de datos, se favorece la presunción de competencia de la Ofic. Fed. Antimonopolio de Alemania. En caso de que facebook interponga un recurso contra la decisión cabe esperar más conclusiones.
