[value] => Das Paket mit Vertragsverletzungsverfahren in den Bereichen Besteuerung und Zollunion, welches die EU-Kommission im März schnürte, enthält auch zwei Verfahren gegen Spanien.
Die Kommission hat Spanien dazu aufgefordert, die diskriminierende Behandlung von nicht in Spanien Ansässigen bezüglich der Besteuerung von Mieteinnahmen in Spanien zu beenden. Im Rahmen der Einkommensteuer genießen in Spanien Ansässige eine Reduktion von 60% der Nettomieteinnahmen aus Immobilien, welche durch den Mieter als ständiger Wohnsitz genutzt werden. Da diese Reduktion keine Anwendung auf die Einkommensteuer für Nichtresidente findet, werden Investoren, die in einem anderen Mitgliedsstaat des Europäischen Wirtschaftsraums (EWR) ansässig sind, anders steuerlich behandelt, wodurch der freie Kapitalverkehr des Art. 63 des Vertrags über die Arbeitsweise der Europäischen Union (AEUV) ungerechtfertigter Weise eingeschränkt wird.
Ferner warnt die Kommission bezüglich der Wertzuwachssteuer aus Aktien für in Norwegen, Island, oder Lichtenstein ansässige Steuerzahler. Unter bestimmten Bedingungen erlässt die spanische Gesetzgebung die Wertzuwachssteuer aus Aktienübertragungen für in Spanien und der EU steuerlich Ansässige. Die Mitgliedsstaaten der Europäische Freihandelsassoziation, die Teil des EWR sind, können jedoch nicht von dieser Befreiung profitieren.
Wenn Spanien seine Vorschriften für die Einkommensteuer für Nichtresidente in den nächsten Monaten nicht so anpasst, dass die Grundlagen des AEUV nicht mehr verletzt werden, kann die Kommission den spanischen Behörden eine begründete Stellungnahme senden. Das EU-Recht respektierend, wurden an unserer Einkommensteuer für Nichtresidente bereits signifikante Änderungen vorgenommen, z.B. bezüglich der Bestimmung der Bemessungsgrundlage für ohne Betriebsstätte erwirtschaftete Einkünfte von in der EU steuerlich Ansässigen, wodurch Ausgaben gesenkt werden können.

Primero, la Comisión ha pedido que se elimine el trato fiscal discriminatorio a los no residentes arrendadores en relación con los ingresos derivados del alquiler de viviendas en España. A efectos del Impuesto sobre la Renta de las Personas Físicas (IRPF), los residentes fiscales en España disfrutan de una reducción del 60% de los ingresos netos obtenidos por el alquiler de bienes inmuebles utilizados por el arrendatario como vivienda. Así, los inversores residentes en otro estado miembro del Espacio Económico Europeo (EEE), dado que según nuestro Impuesto sobre la Renta de No Residentes (IRNR) no permite aplicar dicha reducción, están sujetos a un trato diferente que restringe indebidamente la libre circulación de capitales señalada en el art. 63 del Tratado de Funcionamiento de la Unión Europea (TFUE).
El segundo procedimiento de infracción afecta a las plusvalías procedentes de acciones para los contribuyentes residentes en Noruega, Islandia y Liechtenstein. En determinadas condiciones, la legislación española exime de impuestos sobre plusvalías derivadas de las transferencias de acciones a residentes fiscales en España y en otros estados miembro de la UE. Sin embargo, los residentes fiscales en los estados de la AELC, que participan en el EEE, no pueden beneficiarse de dicha exención.
Si España no modifica en los próximos meses la normativa interna del IRNR para no vulnerar en ambos casos los principios del TFUE, la Comisión podrá enviar un dictamen motivado a las autoridades españolas. Nuestro IRNR ya ha sido objeto de modificaciones significativas, respetando los derechos comunitarios, p.ej. la que afecta a la determinación de la base imponible correspondiente a rentas que se obtengan sin mediación de establecimiento permanente por contribuyentes residentes en otro estado miembro de la UE, permitiendo deducir gastos.
