[value] => Die Vermietung einzelner Zimmer, sei es aufgrund schwierigen Zugangs zum verfügbaren Wohnraum oder um die Hürden zu umgehen, die viele Gemeinden der touristischen Nutzung von Wohnraum auferlegen, ist ein aufsteigendes Phänomen. Mit Urteil vom 28. März 2019 schaffte das Landesgericht Madrid nun Klarheit darüber, welches Gesetz bei Zimmervermietungen zur Anwendung kommt. Demnach ist für die Beurteilung über Verträge über Zimmervermietungen nicht etwa das Gesetz über die Vermietung von Wohnräumen, kurz LAU, sondern vielmehr das Bürgerliche Gesetzbuch anwendbar.
Diese Entscheidung wurde auf Artikel 2 LAU gestützt, nachdem unter Wohnungsmiete eine Miete über eine Wohnräumlichkeit zu verstehen ist, dessen Hauptzweck es ist, den ständigen Wohnbedarf des Mieters zu befriedigen. Viele Stimmen der Lehre und Rechtsprechung meinten, dass eine Zimmermiete die Entwicklung eines häuslichen Lebens des Mieters und die damit einhergehende und als unverzichtbar angesehene Privatsphäre samt deren Annehmlichkeiten nicht garantieren könne. Diese Vorteile würden nämlich nur partiell zur Verfügung stehen. Denn die Vermietung eines Zimmers beinhalte zwar dessen ausschließliche Nutzung, sowie das Recht auf Nutzung des Bads, des Wohnzimmers und der Küche, jedoch seien die restlichen Räume der exklusiven Nutzung des Eigentümers vorbehalten, der somit als Einziger von diesen profitiert.
Im LAU statuierte Bestimmungen hinsichtlich obligatorischer Vertragsver-längerung, Zession, Übertragung unter Lebenden oder durch Vererbung, Vorkaufs- und Widerrufsrechten, Mindestdauer etc., sind folglich also nicht auf Verträge über Zimmervermietungen anwendbar. Diese Rechtsfragen werden bei Zimmermieten vielmehr durch Parteienvereinbarung bzw. allenfalls durch Art 1.154 ff Bürgerliches Gesetzbuch gelöst. Aus diesem Grund hat der Mieter bei Miete eines Zimmers unter anderem nicht die Möglichkeit, von dem Zwangsverlängerungsrecht Gebrauch zu machen, das ihm das LAU gewährt, wenn im Vertrag eine kürzere als die im LAU statuierte Mindestlaufzeit angegeben ist.

[value] => El arrendamiento de habitaciones, ya por las dificultades de acceso a la vivienda o ya sea para procurar sortear las trabas que al alquiler de uso turístico imponen muchos municipios, es un fenómeno al alza. Esta cada vez más empleada figura ha generado una gran incertidumbre en lo que respecta al régimen jurídico que se le aplica y, por ello resulta de interés la Sentencia dictada por la Audiencia Provincial de Madrid el 28 de marzo de 2019, que concluye que los contratos de arrendamiento de habitaciones no se regulan por la Ley de Arrendamientos Urbanos, en adelante LAU, sino por el Código Civil.
Esta decisión tiene su fundamento en el artículo 2 de la LAU, el cual señala que se considera arrendamiento de vivienda, aquel que recae sobre una edificación habitable cuyo destino primordial es satisfacer la necesidad permanente de vivienda del arrendatario. Gran parte de la doctrina y jurisprudencia ha señalado que una habitación no puede garantizar el desarrollo de la vida doméstica del inquilino con la intimidad y servicios que se consideran indispensables, ya que de ellos se dispone de forma compartida, pues el arrendamiento de habitaciones contempla el uso exclusivo de la habitación con derecho a usar el baño, sala de estar y cocina, permaneciendo el resto de habitaciones bajo el ámbito de uso y disfrute de su propietario.
Algunas de las consecuencias de esta calificación es que aspectos como el de la prórroga forzosa, cesión, subrogación intervivos y mortis causa, derechos de tanteo y retracto, duración mínima… no son aplicables a los contratos de arrendamiento de habitaciones, pues estos se rigen por lo pactado entre las partes y en su defecto por las disposiciones del Código Civil, artículo 1.154 y siguientes.
Es por ello, que en el arrendamiento de habitación, el inquilino no tiene la posibilidad de acogerse, entre otros, al derecho de prorroga forzosa que le permite la LAU cuando en el contrato se haya hecho constar una duración inferior a la señalada por ley.
