[value] => Die Verpflichtung zur täglichen Erfassung der Arbeitszeit ist nunmehr eine Realität. Nach Veröffentlichung am vergangenen 12. März 2019 des Königlichen Gesetzesdekrets 8/2019, vom 8. März, über dringende Maßnahmen des Sozialschutzes und zur Bekämpfung der Prekarität der Arbeitszeiten, besteht die Verpflichtung aller Unternehmen, täglich die Arbeitszeit der gesamten Belegschaft zu registrieren. Diese tägliche Arbeitszeiterfassung muss zwingend sowohl den Beginn als auch das Ende der Arbeitszeit jedes einzelnen Mitarbeiters festhalten. Daher ist jedes Unternehmen verpflichtet, eine exakte Registrierung der Arbeitszeit aller seiner Mitarbeiter in den verschiedenen Arbeitszentren vorzunehmen, die täglich erfolgen muss und die während eines Zeitraums von vier Jahren zu verwahren ist, um den Arbeitnehmern, den Gewerkschaften und der Arbeitsinspektion zur Verfügung zu stehen.
Das Königliche Gesetzesdekret gibt dabei kein konkretes System zur Registrierung der Arbeitszeiten vor, sondern erlaubt es, die tägliche Erfassung sowohl anhand eines entsprechenden Dokumentes oder mittels eines Registrierungssystems oder mittels jeden anderen Mittels zu erfüllen, das in beweiskräftiger Form die von den Arbeitnehmern geleistete Arbeitszeit erfasst.
Die neue Vorschrift führt zudem zu einer Änderung des Gesetzes über die Verstöße gegen die Sozialordnung: Der Verstoß gegen die Verpflichtung der Unternehmen zur Erfassung der täglichen Arbeitszeit kann mit einer Sanktion geahndet werden, die sich je nach Schweregrad auf einen Betrag von zwischen 626.-Euro und 6250.- Euro beläuft. Die Verpflichtung zur täglichen Registrierung der Arbeitszeit wird am 12. Mai 2019 in Kraft treten, so dass die Unternehmen in Spanien in weniger als zwei Monaten das entsprechende Erfassungssystem eingeführt haben müssen, um dieser neuen Verpflichtung nachzukommen.

Tras la publicación el pasado día 12 de marzo de 2019 del Real Decreto Ley 8/2019, de 8 de marzo, de medidas urgentes de protección social y de lucha contra la precariedad laboral en la jornada de trabajo, se impone la obligatoriedad a las empresas de tener un registro diario de la jornada de trabajo de todos sus empleados. Este registro diario debe incluir necesariamente tanto la hora de inicio como la hora de finalización de la jornada de cada uno de los trabajadores. Toda empresa está, por lo tanto, obligada a tener un registro diario de la jornada exacta de sus trabajadores en cada uno de sus centros de trabajo, que diariamente deberá ser cumplimentado y que se deberá conservar durante un periodo de cuatro años, manteniéndose a disposición de los empleados, sindicatos e Inspección de Trabajo y Seguridad Social.
El Real Decreto no establece un sistema concreto de registro de la jornada, se permitirá realizar el registro diario obligatorio tanto mediante el correspondiente documento de registro como a través de sistemas de fichaje o a través de cualquier otro medio que acredite de forma fehaciente las horas diarias realizadas por los trabajadores.
Esta novedad supone también una modificación en la Ley de Infracciones y Sanciones del Orden Social, pues se incluye ahora una nueva infracción empresarial sancionable: el incumplimiento de las empresas en relación con el registro diario de la jornada podrá conllevar una sanción, que podrá oscilar (dependiendo del grado) entre los 626.- euros y 6250.- euros. La obligación de registro de la jornada diaria entrará en vigor el día 12 de mayo de 2019, por lo que las empresas en tan sólo dos meses tendrán que haber implementado el correspondiente sistema de registro para cumplir con esta nueva obligación.
