[value] => Die Frage der gerichtlichen Zuständigkeit ist in der Praxis immer wieder ein wichtiges Thema. Denn hiervon hängt unter anderem ab, mit welchem Kostenaufwand ein Rechtstreit zu führen ist. Es macht eben einen erheblichen Unterschied, ob ein Kläger vor einem inländischen oder auslän-dischen Gericht gegen einen Beklagten vorgehen muss (Einschaltung eines weiteren Anwalts im Verfahrensstaat, gegebenenfalls Übersetzungskosten, Reisekosten, etc.).
Vor diesem Hintergrund ist eine ganz aktuelle Entscheidung des EuGH interessant, in der es um die Verletzung einer Unionsmarke durch einen in Spanien ansässigen Rechtsverletzer ging. Die Werbung bzw. Verkaufsangebote für die verletzte Marke richteten sich an Verbraucher und Händler im Vereinigten Königreich. Eine Unionsmarke ist eine Marke, die aufgrund Eintragung im Europäischen Markenamt in Alicante Geltung in der gesamten Europäischen Union beansprucht.
Die Markeninhaberin hatte Klage vor dem Intellectual Property and Enterprise Court in London erhoben. Gegen das Urteil wurde beim Court of Appeal (England and Wales) Berufung eingelegt und dieses Gericht hat die Frage der Zuständigkeit durch den EuGH klären lassen. Der EuGH hat zunächst festgestellt, dass sich die Frage der internationalen Zuständigkeit bei Unionsmarken ausschließlich nach der entsprechenden Vorordnung 207/2009 richtet und nicht nach den allgemeinen Zuständigkeitsvorschriften in der sogenannten Brüssel-Ia-Verordnung. Der entscheidende Aussagegehalt der EuGH-Entscheidung liegt in der Feststellung, dass auch die Unionsmarkengerichte desjenigen Mitgliedsstaats zuständig sind, in dem sich die Verbraucher oder Händler befinden, an die sich diese Werbung oder Verkaufsangebote richten, auch wenn die Verletzungshandlungen elektronisch von einem anderen Mitgliedsstaat aus (in diesem Falle Spanien) veranlasst worden sind. Dies ist eine wichtige klarstellende Entscheidung des EuGH, die es den Markeninhabern erleichtert, ihre Ansprüche durchzusetzen.

[value] => La cuestión relativa a la competencia judicial sigue siendo, en la práctica, un tema importante. De ello dependerá, entre otras cosas, el coste de un procedimiento. Así, existe una gran diferencia en el hecho de que el demandante deba iniciar un procedimiento judicial contra el demandado ante un órgano jurisdiccional nacional o extranjero (intervención de otro abogado en el país en el que se lleve a cabo el procedimiento, y, en su caso, gastos de traducción, de desplazamientos, etc.).
En este contexto, resulta interesante una reciente sentencia del TJUE relativa a la violación de una marca de la UE por un infractor que tiene su domicilio en España. La publicidad y las ofertas de ventas se dirigían a consumidores y distribuidores en Reino Unido. Una marca de la UE es una marca que con motivo de su inscripción en la Oficina de Propiedad Intelectual de la UE en Alicante confiere a su titular un derecho exclusivo en toda la UE.
El titular de la marca interpuso la acción ante la Intellectual Property Enterprise Court en Londres, siendo la resolución de dicho Tribunal apelada ante la Court of Appeal (England and Wales), quien decidió aclarar la cuestión de la competencia judicial a través del TJUE. El TJUE estableció en primer lugar la aplicación del Reglamento n° 207/2009 para resolver la cuestión relativa a la competencia judicial, quedando excluidas las disposiciones generales de competencia del denominado Reglamento “Bruselas I bis”. Lo decisivo de esta sentencia del TJUE es que los tribunales de marcas de la Unión del Estado miembro en cuyo territorio se encuentren consumidores y distribuidores a los que se dirijan esa publicidad u ofertas de ventas serán también competentes, aun cuando la actividad infractora se haya llevado a cabo electrónicamente desde otro Estado miembro (en este caso, España). Se trata de una importante sentencia aclaratoria del TJUE que facilita a los titulares de las marcas la interposición de acciones.
