[value] => In unserem Beitrag vom Januar d.J. beschäftigten wir uns mit den Änderungen im Wohn- und Mietrecht, die durch das Königliche Gesetzesdekret 21/2018 eingeführt worden waren, aber nur ein paar Wochen in Kraft waren, da das Parlament das Gesetzesdekret nicht ratifizierte.
Am 1. März 2019 hat die Regierung nun erneut ein Königliches Gesetzesdekret (Real Decreto-Ley 7/2019) über dringende Maßnahmen im Bereich des Wohn- und Mietrechts verabschiedet. Diese Norm ist seit dem 6. März 2019 in Kraft und ist auch vom Parlament ratifiziert worden, so dass ihre Gültigkeit dieses Mal (vielleicht) länger andauern wird.
Enthält das neue Gesetzesdekret die selben Änderungen wie das Gesetzesdekret 21/2018? Nein, nicht alle Änderungen, die das Gesetzesdekret 21/2018 enthielt, sind in der neuen Regelung wiederzufinden, dafür aber einige Neuigkeiten, insbesondere folgende:
- Eine Eintragung des Mietvertrages im Grundbuch zwecks Wirkung Dritten gegenüber während der Mindestvertragsdauer ist nicht mehr erforderlich. Diese neue Regelung entspricht der Regelung, die vor der Reform von 2013 in Kraft war.
- Die für den Vermieter zwingende Mindestvertragsdauer wird von 3 auf 5 Jahre erhöht, (auf 7, falls der Vermieter eine juristische Person ist), plus 3 zwingende Verlängerungen von je einem Jahr.
- Die Kündigungsfrist beträgt für den Vermieter 4 Monate; für den Mieter 2 Monate.
- Damit sich der Vermieter der zwingenden Verlängerung widersetzen kann, muss der Vertrag die Nicht-Verlängerung wegen Eigenbedarf ausdrücklich vorsehen.
- Die Garantien, die der Vermieter zusätzlich zur Kaution fordern kann, dürfen den Betrag von 2 Monatsmieten nicht übersteigen.
Diese durchaus wichtigen Neuerungen finden auf alle ab dem 6. März 2019 unterschriebenen Mietverträge Anwendung.
[summary] => [format] => full_html ) ) [x-default] => Array ( [0] => Array ( [value] =>En nuestro artículo del pasado mes de enero hacíamos referencia a las modificaciones que el Real Decreto-Ley 21/2018, introducía en el régimen de arrendamientos urbanos, que finalmente no fue convalidado por el Congreso, por lo que tuvo apenas unas semanas de vigencia.
Sin embargo, el pasado 1 de marzo se aprobó por el gobierno un nuevo Real Decreto-Ley, el 7/2019, de medidas urgentes en materia de vivienda y alquiler. Dicha norma, en vigor desde el pasado 6 de marzo, esta vez sí ha sido convalidada por el Congreso, por lo que se encuentra plenamente en vigor, y dicha vigencia será (quizás) algo mayor.
¿Introduce este Real Decreto-Ley las mismas modificaciones que el del mes de diciembre? Pues aunque lo lógico sería pensar que sí, lo cierto es que no: algunas sí son las mismas, otras no cambian y hay más novedades. Veamos las novedades principales:
- Ya no es necesaria la inscripción del contrato en el Registro de la Propiedad para que el mismo produzca efectos frente a terceros durante el periodo de duración mínima obligatoria. En este punto, vuelve a la norma anterior a la reforma del año 2013.
- Los años de duración del contrato obligatorios para el arrendador pasan a ser de tres a cinco años, más tres de prórroga por plazos anuales, excepto si el arrendador era una persona jurídica, que entonces serían siete años, más tres de prórroga por plazos anuales.
- La denuncia del contrato debe hacerse con cuatro meses de antelación en el caso del arrendador y con dos meses en el caso del arrendatario.
- Se exige de nuevo que en el propio contrato se haga constar de forma expresa la necesidad del arrendatario de ocupar la vivienda para sí, para que no proceda la prórroga obligatoria del contrato.
- También se limitan a un máximo de dos mensualidades las garantías adicionales a la fianza que puede exigir el arrendatario y se limita también la actualización de la renta al IPC.
Son, sin duda, novedades importantes, que resultan de aplicación a todos los contratos que se suscriban a partir del pasado día 6 de marzo.
