[value] => Gehälter, Löhne und ähnliche Vergütungen, die eine in Spanien ansässige Person aus unselbständiger Arbeit bezieht, können unabhängig von Art und Weise sowie Ort der Zahlung in Deutschland besteuert werden, soweit die Vergütung für eine dort ausgeübte Tätigkeit bezogen wird.
Ein deutsches Besteuerungsrecht besteht nach Art. 15 (2) DBA jedoch nicht, soweit (a) der Empfänger sich in Deutschland insgesamt nicht länger als 183 Tage innerhalb eines Zeitraums von 12 Monaten, der während des betreffenden Steuerjahres beginnt oder endet, aufhält und (b) die Vergütungen von einem Arbeitgeber oder für einen Arbeitgeber gezahlt werden, der nicht im anderen Staat ansässig ist, und (c) die Vergütungen nicht von einer Betriebsstätte getragen werden, die der Arbeitgeber im anderen Staat hat. Arbeitgeber in diesem Sinne ist der sog. „wirtschaftliche Arbeitgeber“, also derjenige, der die Vergütungen für die ihm geleistete Tätigkeit wirtschaftlich trägt, ob dieser auch zivilrechtlich Arbeitgeber ist, ist steuerlich irrelevant.
Bei gewerblicher Arbeitnehmerüberlassung an deutsche Unternehmen sind Mitarbeiter spanischer Unternehmen daher unabhängig von Ihrer Aufenthaltsdauer vom ersten Tag ihrer Tätigkeit an in Deutschland steuerpflichtig, so dass sich letztere in Deutschland als Arbeitgeber registrieren und für ihre in Deutschland eingesetzten Mitarbeiter Lohnsteuer anmelden und abführen müssen, geschieht dies nicht, haftet der deutsche Kunde für die nicht abgeführte Lohnsteuer. Bei der Frage, wer die Vergütungen trägt kommt es zwischen verbundenen Unternehmen darauf an, wem und gegebenenfalls im welchen Umfang die vom Arbeitnehmer ausgeübte Tätigkeit nach Verrechnungspreisgrundsätzen funktional zuzuordnen ist.
Ob eine deutsche Tochtergesellschaft für die nicht abgeführte Lohnsteuer eines ausländischen Geschäftsführers auch haftet, wenn dessen Vergütung nicht nach Deutschland weiterbelastet wurde, ist Gegenstand eines Revisionsverfahrens (BFH VI R 22/19), mit Wirkung ab 2020 soll die Abzugsverpflichtung und Haftung in diesem Fall gesetzlich klargestellt werden.

Ahora, Alemania no tendrá el derecho de imposición, si tanto
(a) el perceptor permanece en Alemania durante un período o períodos cuya duración no exceda en conjunto de 183 días en cualquier período de 12 meses que comience o termine en el año fiscal considerado y
(b) las remuneraciones se pagan por un empleador que no sea residente del otro Estado, o en su nombre y
(c) las remuneraciones no las soporta un establecimiento permanente que el empleador tenga en el otro Estado.
Aquí el empleador es el llamado „empleador económico“, es decir, quien soporta económicamente los pagos para la realización del empleo, sin importar tributariamente si es también empleador según los criterios del derecho civil.
En el caso de una cesión de personal de una empresa española, la cual se dedica principalmente a la cesión de trabajadores para empresas alemanas, este personal cedido, independientemente del tiempo de estancia dispuesto, está desde su primer tarea realizada sometido a imposición en Alemania, de modo que la empresa española debe registrarse como empleador en Alemania y por dichos trabajadores cedidos a Alemania debe efectuar retenciones sobre sus remuneraciones, si faltara, entonces el cliente alemán es el responsable de pagar el impuesto no declarado sobre dichas remuneraciones.
En cuanto a quién soporta la remuneración, si se tratara de empresas vinculadas, se aplicará una imputación según un criterio funcional y cuantitativo conforme a los principios de precios de transferencia. En un procedimiento de casación ante el Tribunal Federal Supremo de lo Fiscal (BFH VI R 22/19) se está revisando si una filial alemana es la responsable por la falta de retenciones del IRPF alemán sobre la remuneración de un administrador extranjero, aun cuando la misma no se haya refacturado a Alemania, lo que aclarará la ley a partir del 2020.
