[value] => Am vergangenen 16. Februar ist die Verordnung (EU) 2016/1191, vom 6. Juli 2016, zur Förderung der Freizügigkeit von Bürgern durch die Vereinfachung der Anforderungen an die Vorlage bestimmter öffentlicher Urkunden innerhalb der Europäischen Union in Kraft getreten.
Dank der Freizügigkeit der Personen innerhalb der EU kommt es heute häufig vor, dass sich Bürger eines EU-Staates in einem anderen EU-Staat aufhalten. Oft ist es erforderlich im Aufenthaltsstaat bestimmte Aspekte betreffend den Personenstand (Geburt, Ehe, Name, Tod, u.s.w.), nachzuweisen, z.B. um eine Erbschaft anzunehmen oder eine Ehe zu schliessen. Die erwähnten Sachverhalte werden normalerweise durch im Ursprungsstaat ausgestellte Dokumente nachgewiesen. Damit die Dokumente im Ausland anerkannt werden, müssen sie „legalisiert“ oder „apostilliert“ werden, was eine zusätzliche Formalität bei der Ausstellung der erwähnten Dokumente bedeutet, die mit Zeitaufwand und Kosten für den Bürger verbunden ist.
Mit der Verordnung, die jetzt in Kraft getreten ist, werden bestimmte öffentliche Urkunden von dieser Formalität befreit, um die Anerkennung dieser Dokumente in anderen Unionsstaaten für die Bürger zu erleichtern. Die erwähnte Verordnung gilt für öffentliche Urkunden, die dazu dienen folgende Sachverhalte zu belegen: Die Geburt, die Tatsache, dass eine Person am Leben ist, den Tod, den Namen, die Eheschlieβung (einschlieβlich Ehefähigkeit und Familienstand), die Ehescheidung, die Trennung oder Ungültigkeitserklärung einer Ehe, die eingetragene Partnerschaft, die Auflösung einer eingetragenen Partnerschaft, die Abstammung, die Adoption, den Wohnsitz oder Aufenthaltsort, die Staatsangehörigkeit, u.s.w.
Ferner ist es in Zukunft auch nicht mehr erforderlich, die erwähnten Dokumente in die Sprache eines anderen Mitgliedstaates zu übersetzen, sofern sie auf den mehrsprachigen durch die Verordnung eingeführten Formularen ausgestellt sind.
Es handelt sich jedenfalls um eine lobenswerte Initiative, die hoffentlich eine Vereinfachung der bisher bestehenden Verwaltungsanforderungen für die Bürger bedeutet.

[value] => El pasado 16 de febrero entró en vigor el Reglamento (UE) 2016/1191, de 6 de julio de 2016, por el que se facilita la libre circulación de los ciudadanos simplificando los requisitos de presentación de determinados documentos en la Unión Europea.
Hoy en día, y gracias a la libre circulación de personas dentro de la UE, son muy numerosas las personas nacionales de un Estado de la UE que sin embargo residen en otro Estado de la UE. En muchas ocasiones resulta necesario acreditar en el Estado de residencia determinados aspectos de su estado civil (nacimiento, matrimonio, nombre, defunción, etc.), por ejemplo para formalizar una herencia, o para contraer matrimonio. Dichas circunstancias se acreditan mediante documentos expedidos normalmente en su Estado de origen y, para que dichos documentos se reconozcan en un país extranjero, deben ser “legalizados” o “apostillados”, que, explicado de forma sencilla, supone un trámite adicional más en la expedición del documento de que se trate, que supone un gasto añadido en tiempo y en dinero para el ciudadano.
Mediante el Reglamento que ahora entra en vigor, se exime de este trámite a determinados documentos públicos, con el fin de facilitar a los ciudadanos el reconocimiento de esos documentos en otros países de la Unión. Así, se aplica a los documentos públicos que tengan como fin acreditar el nacimiento, el hecho de que una persona está viva, la defunción, el nombre, el matrimonio (incluidos la capacidad para contraer matrimonio y el estado civil), el divorcio, la separación judicial o la anulación del matrimonio, la unión de hecho registrada, la cancelación del registro de una unión de hecho, la filiación, la adopción, el domicilio o la residencia, la nacionalidad, etc.
Se elimina también la necesidad de tener que traducir esos documentos a la lengua del otro Estado, si se expiden en los formularios multilingües que el propio Reglamento establece.
En definitiva, se trata de una iniciativa loable que esperemos facilite algunos trámites a los ciudadanos.
