[value] => Eine Haftung des Unternehmers nach § 14 Arbeitnehmerentsendegesetz (AEntG) für die Zahlung des Mindestentgelts an Arbeitnehmer ist ausgeschlossen, sofern der Auftraggeber nicht die Erfüllung eigener Verpflichtungen an einen Subunternehmer weitergegeben hat - entschied das Bundesarbeitsgericht (BAG).
Die Beklagte ließ ein Einkaufszentrum errichten, das sie verwaltet und in welchem sie Geschäftsräume an Dritte vermietet. Für den Bau beauftragte sie einen Generalunternehmer, der wiederum Subunternehmer einsetzte. Der Kläger war bei einem der Subunternehmer beschäftigt. Dieser blieb dem Kläger Lohn schuldig. Die auf Zahlung des ausstehenden Nettolohns gerichtete Klage gegen die Bauherrin blieb nun auch vor dem BAG erfolglos. § 14 AEntG normiert, dass ein Unternehmer, der einen anderen Unternehmer mit der Erbringung von Werk- oder Dienstleistungen beauftragt, für dessen Verpflichtung zur Zahlung eines Mindestentgelts wie ein Bürge haftet, der auf die Einrede der Vorausklage verzichtet hat.
Der Begriff des Unternehmers ist im Einklang mit der Rechtsprechung zu § 1 AEntG aF einschränkend auszulegen. Erfasst wird nur der Unternehmer, der sich zur Erbringung einer Werk- oder Dienstleistung verpflichtet hat und diese nicht mit eigenen Arbeitskräften erledigt. Stattdessen bedient er sich zur Erfüllung seiner Verpflichtung eines oder mehrerer Subunternehmer. Sofern der Generalunternehmer auf diese Weise die Beachtung der Mindestarbeitsbedingungen aus der Hand gibt, ist es gerechtfertigt, ihm die Haftung für die Erfüllung der Mindestlohnansprüche aufzuerlegen. Für die Beklagte gelte dies jedoch gerade nicht, so das BAG. Sie habe als Bauherrin den Auftrag für den betrieblichen Eigenbedarf an einen Generalunternehmer erteilt und damit nicht die Erfüllung eigener Verpflichtungen an einen Subunternehmer weitergegeben. Mit der Vergabe des Bauauftrags schaffe sie vielmehr die Grundlage dafür, ihrem Geschäftszweck nachgehen zu können. Entsprechend führte auch das LAG bereits aus, die Betreiberin des Einkaufzentrums habe mit der Beauftragung gerade keine Verantwortungsbeziehung begründet.

[value] => El Tribunal Federal de Trabajo alemán (BAG) ha fallado que es conforme con el art. 14 de la Arbeitnehmerentsendegesetz (AEntG), Ley sobre el desplazamiento de trabajadores, que el contratante no es responsable del pago del salario mínimo a los empleados por un subcontratista, a menos que haya transferido el cumplimiento de sus propias obligaciones a éste.
La demandada gestionaba un centro comercial en el que alquila locales comerciales a terceros y cuya construcción encargó a un contratista general quien, a su vez, contrató a varios subcontratistas. El demandante fue contratado por uno de estos subcontratistas que incumplió con su obligación del pago del salario, por lo que fue demandado. El BAG negó una co-responsabilidad salarial, estimando como no justificada la reclamación del demandante al pago del salario neto.
El art. 14 AEntG establece que un empresario que encarga a otro la prestación de servicios o la ejecución de obras es responsable de la obligación del pago del salario mínimo por el subcontratista como un garante que ha renunciado al beneficio de excusión. De conformidad con la jurisprudencia sobre la versión anterior del art. 1 AEntG, el término de empresario debe interpretarse de forma restrictiva. Por tanto, en la medida en que el contratante general delega su propia obligación de cumplir con los estándares mínimos de trabajo, se puede justificar una co-responsabilidad. Sin embargo, según el BAG esto no era el caso de la demandada. Como propietaria del edificio y para sus propias necesidades operativas, adjudicó la construcción a un contratista general y, por tanto, no transfirió el cumplimiento de sus propias obligaciones a un subcontratista. La adjudicación de un contrato de obras por la demandada tenía el fin de que ésta pudiera continuar con su actividad comercial. Conforme a esto, el LAG (Tribunal Superior de Trabajo) ya había alegado que la operadora del centro comercial no había establecido ninguna relación de responsabilidad con la contratación.
