[value] => Ab dem 1. Januar 2020 treten folgende Mehrwertsteuermaßnahmen für den innergemeinschaftlichen Handel in Kraft:
1. Konsignationslager (“Call-off Stock”) Bisher konnte diese Art von Geschäften zu drei Transaktionen führen, bei denen sich der Lieferant im Bestimmungsland ausweisen und den innergemeinschaftlichen Erwerb melden musste. Ab dem 1. Januar 2020 wird es keine drei Transaktionen mehr geben, sondern nur noch zwei: (i) eine steuerfreie innergemeinschaftliche Lieferung von Waren im Abgangsland und (ii) ein innergemeinschaftlicher Erwerb im Bestimmungsland. Es entfällt das “Verbringen” und damit die Verpflichtung des Lieferanten zur Registrierung im Bestimmungsland.
2. Reihengeschäfte Bei dieser Art von Geschäften kann nur die mit der Beförderung verbundene Lieferung in den Genuss der Steuerbefreiung kommen. Ab dem 1. Januar 2020 wird ein Standard festgelegt, der besagt, welcher Lieferung in der Kette der Transport zugeordnet wird. Der Transport der Lieferung wird dem Zwischenhändler zugeordnet (d.h. die erste Lieferung in der Kette), vorausgesetzt, dass dieser Zwischenhändler eine von einem anderen Mitgliedsstaat als dem Ursprungsland der Waren ausgestellte USt-IdNr. vorgelegt hat.
3. Umsatzsteuer-Identifikationsnummer und zusammenfassende Meldungen Die Aufnahme der Umsatzsteuer-Identifikationsnummer des Erwerbers in das Mehrwertsteuer-Informationsaustauschsystem (VIES) ist eine wesentliche, nicht formale Voraussetzung für die Steuerbefreiung.
4. Vereinfachung des Nachweises für innergemeinschaftliche Beförderung Ab 2020 werden die Beweismittel für den innergemeinschaftlichen Verkehr homogenisiert, um in den Genuss der Steuerbefreiung für die innergemeinschaftliche Lieferung von Waren zu kommen. Es werden zwei iuris tantum-Vermutungen zum Nachweis aufgestellt, dass die Waren in einen anderen Mitgliedsstaat transportiert wurden.

1. Mercancías en consigna
Actualmente, estas transacciones podían dar lugar a tres operaciones, lo que obligaba a que el proveedor tuviese que identificarse en el Estado miembro (“EM”) de destino y declarar la adquisición intracomunitaria de bienes (“AIB”). A partir del 1.1.2020, dejarán de producirse tres operaciones y se producirán tan solo dos: (i) una entrega intracomunitaria de bienes (“EIB”) exenta en el EM de salida y (ii) una AIB en el EM de destino. Desaparecerá el “transfer” y la obligación del proveedor de registrarse en el EM de destino.
2. Operaciones en cadena
En este tipo de operaciones solo la entrega que se vincula al transporte puede beneficiarse de la exención por la EIB. A partir del 1.1.2020 se establece una norma que determina a qué transmisión de la cadena se imputará el transporte. El transporte se imputará a la entrega realizada por el proveedor al operador intermediario (esto es, la primera entrega de la cadena), siempre y cuando el citado operador haya facilitado un NIF-IVA emitido por un EM distinto del país de origen de los bienes.
3. NIF-IVA y declaración informativa recapitulativa
La inclusión del número de identificación a efectos del IVA del adquirente en el sistema VIES será una condición material y no formal, para la aplicación de la exención.
4. Simplificación de la prueba del transporte
A partir del 2020, se homogeneizan los medios de prueba sobre el transporte intracomunitario para aplicar la exención en la EIB. Se establecen dos presunciones iuris tantum para demostrar que los bienes han sido transportados a otro EM.
