[value] => Aufwendungen für die Bewirtung von Personen aus geschäftlichem Anlass dürfen gemäß § 4 (5) Nr. 2 S. 1 EStG ertragsteuerlich den Gewinn nicht mindern, soweit sie 70 % der Aufwendungen übersteigen, die nach der allgemeinen Verkehrsauffassung als angemessen anzusehen und deren Höhe und betriebliche Veranlassung nachgewiesen sind.
Zum Nachweis hat der Steuerpflichtige auf Bewirtungsrechnungen schriftlich Angaben zu Ort, Tag, Teilnehmer und Anlass der Bewirtung sowie der Höhe der Aufwendungen zu machen und diese zu unterschreiben. Weitere Voraussetzung für die ertragsteuerliche Abzugsfähigkeit ist nach der Rechtsprechung des Bundesfinanzhofs (BFH), dass diese jeweils von Anfang an, fortlaufend, zeitnah und gesondert von sonstigen Betriebsausgaben schriftlich festgehalten, d.h. in der Finanzbuchhaltung auf einem getrennten Konto verbucht werden.
Umsatzsteuerlich ist ein Vorsteuerabzug aus Bewirtungsaufwendungen ausgeschlossen, wenn diese privat veranlasst bzw. mitveranlasst oder im Sinne von 4 (5) Satz 1 Nr. 1 bis 4, 7 EStG unangemessen sind, angemessene und nachgewiesene Bewirtungsaufwendungen sind nicht vom Vorsteuerabzug ausgeschlossen.
Das Finanzgericht Nürnberg hat in einem mittlerweile rechtskräftigen Urteil vom 09.04.2019 (5 K 5119/18) entschieden, dass eine Versagung des Vorsteuerabzugs allein aufgrund der Nichteinhaltung von Formvorschriften eine mit dem mehrwertsteuerlichen Neutralitätsgrundsatz nicht vereinbare Belastung darstellen würde und die Abzugsbeschränkungen in § 15 (1a) UStG unionsrechtskonform eng auszulegen sind. Wenn nach der Rechtsprechung des EuGH auch nach längerer Zeit seit erstmaliger Rechnungserstellung noch eine Rechnungsberichtigung möglich sei (vgl. hierzu Ausgaben Januar und Juni 2017 dieses Newsletters), dann könne auch ein nachträglicher und nicht zeitnah erfolgter Nachweis der unternehmerischen Veranlassung nicht zu einer Versagung des Vorsteuerabzugs führen (im Streitfall erfolgte der Nachweis im Einspruchsverfahren ca. vier Jahre nach Bewirtung).

[value] => Los gastos realizados por motivos comerciales para agasajar a invitados no deben reducir la base imponible a efectos de los impuestos sobre la renta, estimándose que no se supere el 70 % de los gastos, que, según la percepción general, se considera adecuado si el importe es demostrable con un justificativo.
Para constatarlo, el contribuyente debe indicar por escrito en todo comprobante de pago relativo al evento el lugar, día, participantes y motivo del agasajo como el importe de los gastos y firmarlo. Otras condiciones son, para la deducibilidad a efectos de los impuestos sobre la renta según la doctrina del Tribunal Federal Supremo de lo Fiscal (BFH), que estos gastos deben ser desde un comienzo registrados consecutivamente en tiempo cercano y deben asentarse separados de otros gastos empresariales, es decir, en la contabilidad financiera deben asignarse a una cuenta propia. A efectos del IVA es relevante destacar la imposibilidad de la deducción de IVA soportado por gastos de agasajamiento cuando los mismos plena o parcialmente privados o bien son excesivos, estando no excluidos de la deducibilidad aquellos gastos considerados apropiados y comprobables.
El Tribunal de lo Fiscal de Núremberg ha emitido una sentencia (5 K 5119/18) el 09/04/2019, mientras tanto ya firme, donde determina que el mero hecho de no haber cumplido con las obligaciones formales no puede implicar la denegación de deducir el IVA soportado por ser una limitación incompatible con el principio de neutralidad del IVA, por lo que la limitación de la deducción se debe interpretar de manera restrictiva a lo dispuesto por la normativa vigente en la Unión Europea. Si según el TJCE podría ser posible una corrección de la primera facturación luego de un largo período (ver boletines 01 y 06/2017), entonces una prueba que justifique la celebración presentada posteriormente, aunque no sea inmediatamente, no puede ser el motivo de la denegación de deducir el IVA soportado (en el pleito se acercó la justificación en el recurso administrativo luego de apróx. 4 años de la fecha del acontecimiento en cuestión).
