[value] => Niemandem bleibt die Tragweite dieser Steuerbefreiung in der Einkommensteuer verborgen, insbesondere die Auswirkungen auf die Arbeitnehmer der Unternehmen oder Niederlassungen in Spanien, die Leistungen im Ausland erbringen, da sich der Betrag der Befreiung auf bis zu 60.000 € belaufen kann. Mit Blick auf die Einkommensteuerfrist am 1. Juli möchten wir die guten Neuigkeiten überbringen, da der TS in seiner jüngsten Rechtsprechung die Anwendung der Steuerbefreiung erleichtert hat.
Um die Befreiung geltend machen zu können, stellte die spanische Steuerbehörde u.a. zwei Bedingungen: Der Leistungsempfänger ist keine in Spanien ansässige Körperschaft und die Leistungen bieten für diesen einen echten Mehrwert. Auf Grundlage dieser Auslegung waren im Ausland geleistete Arbeiten, insbesondere solche innerhalb einer Unternehmensgruppe, im Zusammenhang mit Wirtschaftsprüfungen, internen Prozessprüfungen, Finanzverwaltung, etc. ausgenommen, da die Steuerbehörde der Auffassung war, dass der Empfänger dieser Leistungen das den Arbeitnehmer entsendende Unternehmen ist und nicht das im Ausland niedergelassene. Anders gesagt, hatten die Leistungen des Arbeitnehmers keinen direkten Einfluss auf die Erhöhung der Umsätze oder der Produktion der nicht ansässigen Körperschaft.
Laut TS widerspreche die Auslegung der Steuerbehörde jedoch der Gesetzgebung. So vertritt der TS die Auffassung, dass die Gesetzgebung „der Existenz mehrerer Leistungsempfänger nicht widerspricht“, und wichtiger noch bestimmt, dass „das Gesetz keine bestimmte Dauer der Entsendungen vorschreibt, insbesondere nicht untersagt, dass es sich um Prüf- und Koordinierungsarbeiten handeln kann oder diese Arbeiten sporadisch getätigt werden.“
Folglich empfehlen wir all jenen Arbeitnehmern, die in 2018 Leistungen im Ausland erbracht haben, auch wenn diese nur hin und wieder und als interne Leistung erbracht wurden, auf Grundlage dieser Rechtsprechung ihre Situation zu prüfen, um diesen wichtigen Steuervorteil geltend machen zu können.

Y queremos precisamente comunicar una buena noticia de cara a la campaña del IRPF que finaliza el 1 de julio, pues el TS en una reciente sentencia ha facilitado la aplicación de esta exención.
Para su disfrute, la Administración Tributaria exigía que el beneficiario de los servicios fuera una entidad no residente y que los trabajos produjeran un verdadero valor añadido para esta. En base a dicha interpretación se excluían servicios efectuados fuera de España, especialmente intragrupo, y relacionados con auditorías, control de procedimientos internos, gestión financiera, etc., pues entendía Hacienda que el destinatario de dichos trabajos era la empresa que desplazaba al trabajador y no la extranjera. Dicho de otra manera, los servicios del trabajador no repercutían de una manera directa en la mejora de las ventas o la producción de la entidad no residente.
Sin embargo, el TS considera la anterior interpretación de Hacienda contraria a la norma y dice que esta “no prohíbe que existan múltiples beneficiarios” y, lo que es más importante, establece que “no exige la ley una determinada duración o permanencia en los desplazamientos; en particular, no prohíbe que se trate de labores de supervisión o coordinación y que los trabajos pueden ser incluso esporádicos”.
En conclusión, recomendamos a todos aquellos trabajadores que hayan prestado servicios en el extranjero en 2018, aunque estos fueran puntuales y para tareas internas, que en base a la mencionada sentencia revisen su situación para poder disfrutar de esta importante ventaja fiscal.
